Arizona’s Proposed Interstate Birth Certificate Compact Law Is Both Unconstitutional and Contrary to the Best Interests of the United States

Arizona is considering passing a law that, among other things, would allow a child born in the U.S. to one or two alien parents to be recognized as a “natural born Citizen.” Such a law would be passed in error. Apart from the proposed law being unconstitutional for violating the Supremacy Clause and the Pre-emption Doctrine, a law that recognizes an Article II “natural born Citizen” as including a child born in the U.S. to one or two alien parents would be contrary to what the Founders and Framers designed as a national security safeguard for the Offices of President and Commander in Chief of the Military. In this article, I will address only that part of the proposed law that attempts to define what an Article II “natural born Citizen” is and specifically that part of the law that includes as an Article II “natural born Citizen” a child born in the U.S. to one or two alien parents. In a follow up article, I will address the other parts of the proposed law that I will show are also unconstitutional.

This proposed law is known as SB1308 and is designed to amend Title 36, Chapter 3, by adding what the law calls an interstate compact which concerns U.S. citizenship. The new Article is Article 6, Interstate Birth Certificate Compact 36-361. The proposed law states that the “governor is authorized and directed to enter into a compact on behalf of this state with any of the United States lawfully joined in the compact in a form substantially as follows.”

Article I and III of the new law declare that “[a] person who is born subject to the jurisdiction of the United States is a natural born United States citizen.”

Article II says that “[a]s used in this compact, ‘subject to the jurisdiction of the United States’ has the meaning that it bears in section 1 of the fourteenth amendment to the United States Constitution, namely that the person is a child of at least one parent who owes no allegiance to any foreign sovereignty, or a child without citizenship or nationality in any foreign country.”

Article II also says that “[f]or the purposes of this compact a person who owes no allegiance to any foreign sovereignty is a United States citizen or national, or an immigrant accorded the privilege of residing permanently in the United States, or a person without nationality in any foreign country.”

The proposed law seeks to define an Article II “natural born Citizen” by tying that definition to the 14th Amendment’s “subject to the jurisdiction” clause. It then sets out to define what “subject to the jurisdiction” means. It ties that clause to the child being born to at least one parent who does not have any foreign allegiance. So, the proposed law seeks to tell us what a “natural born Citizen” is by providing us with its own definition of “subject to the jurisdiction” and allegiance. But as we shall see, given how it defines “subject to the jurisdiction” and allegiance, Arizona would allow even a child born to two alien parents to be included as a “natural born Citizen.”

The rolling blackouts now being implemented in Texas and across the country as record cold weather grips the United States are a direct consequence of the Obama administration’s agenda to lay siege to the coal industry, launch a takeover of infrastructure under the contrived global warming scam, and help usher in the post-industrial collapse of America.

Planned power outages conducted by utility companies have caused outrage amongst officials at four major hospitals in Texas, at Parkland, Baylor, Methodist and Presbyterian Dallas.

“Because of the sensitive life-saving equipment, hospitals are considered “critical care facilities,” and supposed to be exempt from rolling blackouts,” reports CBS 11. “That’s exactly what Presbyterian Dallas was led to believe. “We were of the understanding that hospitals and other critical-care providers were not supposed to be affected by planned outages,” said hospital spokesman Stephen O’Brien.”

As well as hospitals, nursing homes, fire stations, police stations, other emergency response facilities have also been hit with outages as demand soars due to freezing temperatures. Many places in Texas now rely on Mexico to supply their power.

“Mexico’s state electricity company on Wednesday started supplying electricity to the US state of Texas, where demand shot up amid unusually cold temperatures and caused power outages,”reports AFP.

Hospitals are supposed to be exempt from the blackouts which hit yesterday, with power company Oncor attributing the outages to a “mistake,” but there were no such mistakes when it came to supplying power to Cowboys Stadium. The government has ensured that the blackouts will not affect Super Bowl venues, a decision that has left residents furious.

Street lights and traffic lights have also been hit by the outages, causing traffic build-ups and other hazards more typically associated with a decrepit underdeveloped country, and not with the supposed leading light of the prosperous first world.

The inability of power companies to meet demand is almost exclusively a consequence of the Obama administration’s publicly stated goal to bankrupt the coal industry and in turn ram through the de-industrialization of America under the guise of the phony global warming mantra.

Even as China and Mexico are allowed to build dozens of new power plants every year, the United States is barely permitted to construct a handful, as the Environmental Protection Agency takes control of refineries and power plants under the completely fraudulent pretext of preventing global warming even as the country experiences some of the coldest weather seen for decades.

Texas has been the epicenter in a battle over the Obama administration’s drive to have the EPA regulate greenhouse gas emissions. Texas is the only state that has refused to implement a permit process.

“Austin said it would not establish such a scheme for greenhouse gas emissions because the US Environmental Protection Agency had no authority to regulate them as of January 2,”reported the Financial Times.

“Twelve other states are mounting a legal challenge to the federal government’s authority but they, unlike Texas, are implementing the new measures while the dispute makes its way through the courts.”

Local environmental officials in Texas were again involved in a fight with the EPA after the, “Texas Commission on Environmental Quality last week approved an air permit for the $3.2 billion Las Brisas Energy Center despite a formal EPA request that the commission delay issuing the permit until EPA’s concerns about the plant’s emissions impacts are fully addressed.”

The Obama administration is conducting industrial warfare against the United States. Obama’s 2008 promise to “bankrupt” the coal industry by placing suffocating restrictions on greenhouse gas emissions even as China and other countries are given free reign to pollute at will is now coming to fruition. This is all part of the “post-industrial revolution” that the global elite have promised to enforce as a means of turning the United States into a decaying banana republic.

It’s also about the federal government’s drive to seize infrastructure and sell it to the highest foreign bidder by gradually squeezing the ability of local independent utility companies to meet demand in American communities.

The shortage of power plants to meet the demands of Texans and other Americans in areas across the country is down to the EPA holding local utility companies hostage and blocking them from building desperately needed new power plants.

Obama’s January greenhouse gas rules restricted the amount of emissions allowable for new power plants, while giving an exemption to General Electric, an intimate administration insider.

Although local coal companies are the ones suffering, the transnational power giants are in on the scam. Knowing that they can move production offshore and produce energy with far fewer costs and restrictions in places like Mexico and China, huge oil companies are constantly contriving artificial scarcity as a means of driving up prices and eliminating competition from smaller utility companies.

As internal memos from the mid-1990′s that were leaked in 2005 show, oil giants like Mobil, Chevron and Texaco are deliberately reducing refining capacity to drive, “independent refiners out of business in an effort to increase prices.”

“Large oil companies have for a decade artificially shorted the gasoline market to drive up prices,” said FTCR president Jamie Court. “Oil companies know they can make more money by making less gasoline.”

Elections: Obama’s Debacle of Historic Proportions Looms for Sociocrats.

Tsunami. Earthquake. Hurricane. Even as pundits struggle to find new metaphors to describe the scope of the GOP landslide expected on Tuesday, the latest polls indicate the midterm grass-roots wave could be even more powerful than analysts are predicting.

Respected political gurus Charlie Cook and Stuart Rothenberg said Monday morning that a 60-seat GOP gain in the House is possible, and a six- to eight-seat GOP gain in the Senate is likely.

“If we’re wrong, it’s higher,” Cook told the audience of MSNBC’s “Morning Joe.”

Like a clarion warning of an impending catastrophe, a new Gallup/USA Today poll released Monday indicates that Democrats could be in for a political bloodletting of historical proportions.

The gap in the generic ballot between two parties has not been greater since the post-Watergate era, the poll reports. By a 55 percent to 40 percent margin, likely voters said they’d prefer to elect a Republican over a Democrat on Tuesday.

Neither party has enjoyed such a dominating position in the generic ballot in more than 35 years, and grass-roots activists were ecstatic about that poll result.

“We’ve known all along that the conservative anti-establishment wave would be huge,” FreedomWorks CEO Matt Kibbe tells Newsmax. “But it’s fitting that the reaction to the establishment agenda is expected to be comparable to the reaction to Watergate. The American people are ready to say that Obamacare, out of control spending and the rest of the far-left agenda are as destructive to our nation as Watergate was.”

Another ominous sign for Democrats: party leaders’ last-minute efforts to boost voter turnout. “Whenever I hear a party say that they are counting on turnout, that means big trouble,” former Bush campaign adviser Mark McKinnon tells Newsmax. “Voters are saying we wanted change, but not the change Obama had in mind.”

Longtime GOP strategist Roger Stone predicts that voters are poised to send Democrats a devastating message of discontent.

“This year’s GOP sweep shows voters want accountability, an end to wasteful spending. and tax reduction,” Stone tells Newsmax. “And they are tired of an ‘elite’ political class that perpetuates it itself but delivers nothing for the people,” Stone says.

“The shock would be if Republicans don’t do well, rather than the fact that they are going to do well,” University of South Florida political science professor Susan McManus tells Newsmax. “Rarely do you see so many polls converge in the same direction with the same magnitude that we see right now. I think that the Republican enthusiasm gap is going to prevail, and Republicans are going to do well around the country.”

In the waning hours of the campaign, many additional indications are emerging that Democrats may now face a debacle that could exceed the GOP gains seen in the conservative revolution of 1994. Among them:

  • An NBC News/Wall Street Journal poll shows about half of all likely voters want a GOP-led Congress. Also, Republicans have a 12-point edge in enthusiasm, 53 percent to 41 percent. “This is a devastating set of data for the incumbent party,” GOP pollster Bill McInturff told NBC News.
  • President Obama’s job-approval rating has dropped 2 points in the past month and now stands at 45 percent, the NBC News/Wall Street Journal poll states.
  • RealClearPolitics.com estimates a whopping 67-seat GOP gain in the House, based on its elaborate analysis of poll results nationwide. Its average GOP edge in the generic ballot, based on an average of 10 recent polls, stands at 8 percent.
  • New polls of specific races bear ominous news for Democrats. Washington Incumbent Democratic Sen. Patty Murray’s lead in the RealClearPolitics average of polls, in a race Democrats lauded as part of their “Pacific Coast firewall,” is now three-tenths of one percent over GOP challenger Dino Rossi.
  • Republicans Ken Buck in Colorado and Sharron Angle in Nevada appear to have established narrow but consistent leads in their respective races. Democratic incumbent Sen. Barbara Boxer’s lead over former Hewlett-Packard CEO Carly Fiorina in California is just 4 points, according to the latest Public Policy Polling data.

There is one caveat to all the bullish predictions of GOP dominance on Tuesday: The Cook Political Report stated on Sunday that the GOP’s chances of winning the 51 votes it needs to control the Senate are “nonexistent.” But even Cook says his projections could underestimate the force of Tuesday’s wave.

Says Stone, “Barack Obama thought the outcome of the 2008 Presidential election was a repudiation of conservatism and a voter approval of higher taxes, massive spending and deeper debt,” Stone tells Newsmax. “This year’s elections prove that this was wrong. Many voters did not understand the ‘change’ they voted for.”

But to capitalize on the strong tide of public sentiment, Republicans will have to avoid their tendency to cause self-inflicted wounds once they gain power.

“The GOP needs to be aware this election was a rejection of Obama and Democrat policies but not necessarily an affirmation of Republicans,” McKinnon says. “A lot of work needs to be done to rebuild the Republican brand.”

Many would say that the Republicans were right not to react, and these same people were comforted that Republicans sat on their hands and remained quiet.  Well they could not be more wrong!

Mexican Meltdown: Iran’s Easy Street To America

The escalating brutality south of our border has now caught the attention of a branch of the Defense Department, if not our President.  The U.S. Joint Forces Command based in Norfolk, Va., has just completed an assessment of the world’s most significant security threats.  The intelligence report concludes: “two large and important states bear consideration for a rapid and sudden collapse: Pakistan and Mexico.”

If the Mexican government were to fail and collapse into chaos, it “could represent a homeland security problem of immense proportions to the Untied States.”  According to the report, Mexico’s “government, its politicians, police, and judicial infrastructure are all under sustained assault and pressure by criminal gangs and drug cartels.”

Former drug czar General Barry McCaffrey describes the situation: “The outgunned Mexican law enforcement authorities face armed criminal attacks from platoon-sized units employing night vision goggles, electronic intercept collection, encrypted communications, fairly sophisticated information operations, sea-going submersibles, helicopters and modern transport aviation, automatic weapons, RPG’s, Anti-Tank 66 mm rockets, mines and booby traps, heavy machine guns, 50 cal sniper rifles, massive use of military hand grenades, and the most modern models of 40mm grenade machine guns.”

Last year, the drug war claimed over 6,616 lives.  And it isn’t just the bad guys who are dying.  In December, a police chief and eight soldiers were found decapitated in the state of Guerrer.  Last month in the Mexican state of Chihuahua, the Police Commander Martin Castro was decapitated and his head was found in a cooler outside the police station.  A calling card of the local drug cartel was enclosed.

According to one reporter, “The border cities of Juarez and Tijuana wake up each morning to find streets littered with mutilated, often headless bodies.  Some victims are dumped outside schools.  Most are wrapped in a cheap blanket and tossed into an empty lot.”

“There is a new and different violence in this war,” said Victor Clark Alfaro, the founder of the Binational Center for Human Rights. “Each method is now more brutal, more extreme than the last.  To cut off heads?  That is now what they like.  They are going to the edge of what is possible for human beings to do.”

And thanks to our wide open borders, the kidnappings, killings, and the thugs that commit them are spilling right into our country.  In December, the U.S. Justice Department’s National Gang Intelligence Center reported that Mexican gangs are the “biggest organized crime threat to the United States.”  Mexican drug cartels now “control most of the U.S. drug market,” and they do so with an unimaginably sophisticated communication systems used to reach organizations in some 230 American cities.

Membership in these gangs is one million strong, and the drug lords of Mexico are major players in the U.S. crime rings in the United States.  According to a recent report by National Drug Intelligence Center, “The influence of Mexican drug trafficking organizations over domestic drug trafficking is unrivaled.”

Criminal Mexican gangs are running billions of dollars worth of drugs into our country and funding violent criminal organizations in hundreds of our towns and cities.  In order to keep their billion dollar enterprise thriving, the drug lords in Mexico have built powerful armies to fight one another and the Mexican government for control of that country.  They could win, and Mexico could collapse into chaos.

The real crime is that for years our leaders have failed to secure the border and Americans have paid the high cost of their cowardice behavior.  Now we are threatened by a foreign enemy smack on our border that is well funded, well armed, as ruthless and brutal as we have ever known.  The threat is far greater than Iraq, Iran, or Afghanistan has ever been — and it is imminent.

There is no more time for baby steps designed to do nothing but give elected officials cover.  Now is the time to get that fence built, supported by the most advanced technology and reinforced with America’s finest — the U.S. Marines.

17 Additional States Taking Action Against Criminal Immigration : Obama Abnegates General Government’s Duty To Protect Borders.

In what is developing into a standoff between states and the federal government that could be bigger than gun control or even health care, 17 states have launched versions of Arizona’s immigration law, even as federal officials say they may not bother to process illegal aliens caught by the states.

William Gheen, president of Americans for Legal Immigration PAC, which has been trying to get officials to address the open southern border for years, warned the consequences could be dire.

“Over the last couple days, Obama and the chief of ICE have refused to honor their oaths of office,” he said. “Their constitutional requirement is to enforce existing laws.

“They’ve told the American public to go eat cake,” he said.

Tell Washington what you think about immigration by sending every member of the Senate “The No Amnesty Pledge.”

His organization is assembling the list of state efforts to emulate the Arizona law, which makes it illegal under state as well as federal law to be in the state without documentation.


“Seventeen states are now filing versions of Arizona’s SB 1070, which is designed to help local police enforce America’s existingimmigration laws,” ALIPAC said in a report today.

The report said numerous national and local polls indicate 60 to 81 percent of Americans support local police enforcing immigrationlaws.

“Our national network of activists have been working overtime trying to help the state of Arizona and the brave Arizonans who have passed this bill,” he said. “Arizona no longer stands alone and we have now documented state lawmakers filing, or announcing they will file, versions of the Arizona bill in seventeen states! We will not stop until all states are protected from invasion as required by the U.S. Constitution.”

Gheen said the states where some form of immigration crackdown is under development include Arkansas, Idaho, Indiana, Maryland, Michigan, Minnesota, Missouri, Nebraska, Nevada, New Jersey, Ohio, Oklahoma, Pennsylvania, Rhode Island, South Carolina, Texas and Utah.

President Obama several times has said he doesn’t like the Arizona law. He’s called it misguided and ordered a review by the Justice Department.

John Morton, who heads the U.S. Immigration and Customs Enforcement, or ICE, said his agency might not process illegal aliens caught under state jurisdiction, the Chicago Tribune reported.

He insisted that only the federal government should respond to the problem.

“I don’t think the Arizona law, or laws like it, are the solution,” Morton said.

One blogger expressed concern that “a senior Homeland Security official has openly declared that he won’t be doing his job.”

“Morton has sworn an oath to uphold the laws of the United States. He is not allowed to pick and choose which ones he likes and which he doesn’t.”

Gheen said the Arizona law and the plans it has spawned in other states is a victory for Americans. But he said those are just battles, and winning the war will require success in elections this fall.

A “comprehensive” solution to the problem will arrive when there are enough “hostile” members of Congress to tell the administration to uphold the existing immigration and border laws or the impeachments will start, he said.

“[We need to send] to Washington a hostile Congress that is going to encircle the executive branch and tell them to [follow the law] or we’ll impeach all the way down to the speaker of the House,” he said.

Gheen said he is alarmed over the pending release, expected sometime just before the election, of a movie called “Machete,” which reportedly is the story of a Mexican uprising in the United States.

Gheen said the message in the movie reportedly is that Americans will either submit to the “rape” of their land or else.

He said he believes the project is intended to create turmoil just as the mid-term elections draw near.

“There is nothing as important right now as getting [people] fully involved with all the campaigns,” he said.

ALIPAC already has helped to pass some form of immigration enforcement legislation in more than 30 states. And Gheen has developed a national reputation for defeating socially progressive plans to hand out licenses, in-state tuition and other taxpayer benefits to illegal aliens.

“It is incumbent upon our states to protect American lives, property, jobs, wages, security, and health, when the executive branch fails to honor its constitutional responsibility to do so by enforcing our existing border and immigration laws,” he said.

The Arizona law, which strictly prohibits racial profiling, empowers local police to enforce immigration laws.

To monitor the growing number of states considering similar legislation, ALIPAC utilizes a public forum in which members can update the organization with news articles and other information from states where the push for an Arizona-like law is making headway.

In Arizona’s neighboring state Utah, for example, Rep. Stephen Sandstrom, R-Orem, reportedly is drafting a bill that would similarly require immigrants to carry proof of status and require law enforcement officers to check for it.

“Utah is seen as state that welcomes illegal immigrants. We almost encourage it with driving privilege cards and in-state tuition for illegals,” Sandstrom told the Salt Lake Tribune. “With Arizona making the first step in this direction, Utah needs to pass a similar law or we will see a huge influx of illegals. The real issue is just establishing a rule of law in our state.”

Across the country in Maryland, Baltimore’s WBAL-TV reported earlier that State Delegate Patrick McDonough, R-Baltimore County, is drafting a bill identical to Arizona’s. He’s also planning to poll his fellow legislators before the bill is filed.

BREAKING – Obama Fearing Revolution Against Him By The States : 14 State Governors Have Reestablished State Militia Defense Forces To Be Ready Against Federal Forces!

Obama fearing a revolution against him by the states, has moved swiftly by nationalizing nearly all National Guard Forces in multiple states; Georgia, Alabama, Kansas, Minnesota, Tennessee, Virginia, Louisiana, South Carolina – to name a few.  The Governors of the Great States of Alabama, Georgia, Louisiana, South Carolina, Tennessee, Texas, and Virginia still have under their Command-and-Control the State Defense Forces to go against U.S. Federal forces should the need arise.  Also important to note:  There are NO U.S. laws prohibiting National Guard troops from also joining their State’s Defense Forces.  This dilemma occurred during the Civil War with many “citizen soldiers” choosing to serve their states instead of the Federal Government.

Obama is angered by the several State Governors who have reestablished “State Defense Forces.”  These forces are described as: “State Defense Forces (also known as State Guards, State Military Reserves, State Militias) in the United States are military units that operate under the sole authority of a state government; they are not regulated by the National Guard Bureau nor are they part of the Army National Guard of the United States.  State Defense Forces are authorized by state and federal law and are under the command of the governor of each state.  State Defense Forces are distinct from their state’s National Guard in that they cannot become federal entities.”

Mr. Obama is fearful of these State Defense Forces, in that he does not have control of said forces, and with the U.S. Military stretched to near breaking from multiple deployments and theatre actions in Iraq and Afghanistan, these State military forces would be under the direct command and authority of the Governors in which states have said forces.  In essence, the Governors would have “de facto control” of the United States.

The two Governors leading this move are:  Tim Pawlenty, Governor of Minnesota; and Rick Perry, Governor of Texas.  Both of these State Governors stated they have: “…deep fear the President is destroying their Nation.”  Governor Pawlenty’s fear of Obama is that since Obama took office he has appeased America’s enemies and has shunned some of America’s strongest allies, especially Israel.  Governor Perry has declared that Obama is punishing his State of Texas by dumping tens-of-thousands of illegal Mexican immigrants into the cities and small towns of Texas.  Governor Perry further recently stated: “If Barack Obama’s Washington doesn’t stop being so oppressive, Texans might feel compelled to renounce their American citizenry and secede from the union.”

Arrogant liberals all over America continue to try to condemn and demonize Arizona for their attempts to keep illegal aliens from flooding in and bankrupting their state. Well, Arizona has responded by passing a law to ban ethnic studies courses.

An article on Fox News reports: “After making national headlines for a new law on illegal immigrants, the Arizona Legislature sent Gov. Jan Brewer a bill Thursday that would ban ethnic studies programs in the state that critics say currently advocate separatism and racial preferences. The bill, which passed 32-26 in the state House, had been approved by the Senate a day earlier. It now goes to Gov. Jan Brewer for her signature. The new bill would make it illegal for a school district to teach any courses that promote the overthrow of the U.S. government, promote resentment of a particular race or class of people, are designed primarily for students of a particular ethnic group or ‘advocate ethnic solidarity instead of the treatment of pupils as individuals.’ …Schools that fail to abide by the law would have state funds withheld.”

They must be serious. They actually put some teeth into it!

Why is Arizona of all places suddenly showing some backbone in racial matters? My guess is that it’s all those White people who fled from southern California over the years and who don’t feel like packing up and moving again. That’s the problem with “White flight.” Whenever White people flee, the Third Worlders always follow. Unfortunately, the good public schools in Arizona start filling up with Latinos. Gang bangers start committing crimes and Latinos start turning Arizona into a copy of a bad L.A. neighborhood.

The next interesting step will be to see what the Obama regime does about all these pro-White laws in Arizona. My guess is that the Attorney General is going to go running to federal judges to get injunctions against the laws. White people however are getting pretty sick of arrogant liberal judges inventing so-called Constitutional reasons to void any law that protects White people or that cuts hand outs to non-Whites.

If White people “working within the system” are not allowed to protect their interests, and the Feds step in to veto a perfectly legitimate state law, what will happen next? Will White people finally decide that they need a radical pro-White party that will support their interests instead of the tepid, timid Republican Party, which has been lacking a spine for decades?

Machete‘ has fallen into controversy, and it’s still months away from its September release. 20th Century Fox, which won a ‘bidding war’ to distribute the film, pulled Rodriguez’ fiery “Illegal” trailer from the web shortly after its special “Cinco de Mayo” message created a storm of controversy and fueled attacks, including one from its sister subsidiary Fox NewsFox News, in turn, pulled the critical article from circulation, entitled “Violent Movie Declares War on Arizona for Immigration Law.”

Worst of all, Robert Rodriguez’ incendiary race film ‘Machete’ was made, in part, with help from tax incentives and location access provided by the Texas Film Commission, a division of Governor Rick Perry’s Office. A spokesperson from the organization confirmed that Rodriguez had indeed applied for funding.

UPDATE: As part of our investigation, Infowars.com reporter Rob Dew contacted the Texas Film Commission on Thursday before the publication of this article. Film Commission staff confirmed that ‘Machete’ was part of the state program, commenting that they fund all of Robert Rodriguez’ Troublemaker Studios films that are shot in Texas. The commission also provided location access to the State Capitol and other state facilities during the production of the film.

After the story gained national attention, we were contacted by Governor Rick Perry’s Press Secretary Allison Castle who contradicted statements made earlier to Infowars by her organization. Castle states that Rodriguez has applied for Machete funding but has not yet received any funding from the commission because the film must be completed first.

Infowars.com is continuing its investigation, because the Film Commission is telling us conflicting stories that don’t add up. Our research shows that in the case of the upcoming film ‘Waco,’ the state legislature and the Texas Film Commission refused funding for the film during pre-production, and a 2007 law passed by the legislature says that anything offensive and that depicts Texas in a negative light will not receive funding. The evidence is clear that films are rejected early in the process and not at the end. Further, the studios where he produced the film are subsidized by the state and city, so either way the film has benefited from taxpayer funds.

Allison Castle, Press Secretary for Gov. Rick Perry, issued the following statement:

The Texas Film Commission only gives funding to projects that have been completed. Troublemaker Studios has applied for funding for three projects: the first, called Shorts, has been completed and is in the audit process in our office. The other two, Machete and Predators, are still in production. Determinations regarding state funding are not made until the Film Commission reviews the final product. At this time, no funds have been released to Troublemaker Studios.

Leaked Machete Script Confirms Race War Plot

The film, originally based on a largely satirical mock-trailer inserted into Rodriguez & Taratino’sGrindhouse, has expanded into full production, and developed a message that many have criticized as glorifying a race war. Among those critics are two anonymous crew members from the production– who happen to be Hispanic– that came forward to warn Alex confidentially about the upsetting script. Further, two individuals who were privy to early screenings of ‘Machete’ have warned that the film is far more racially inflammatory than either the trailer or leaked script have indicated.

By contrast, films like Waco were denied taxpayer-funded resources for fears that it cast Texas in a ‘bad light.’ Attempting to shed the light of truth on one of Texas’ most infamous and controversial episodes is bad, but stoking the fires of racial conflict somehow does Texas “good”?

Yet, no issue has been made of using Texas Film Commission resources to fund Rodriguez’ racist treatise. Why does such a production warrant the support of the people of the State of Texas? Will people standby as as tax breaks and other valuable resources– such as shooting access at the State Capitol, which likely required closing it off from the public– are poured into the creation of divisive, reductive and ultimately offensive portrayal of Mexicans and Americans alike, whether white, black, brown or otherwise.

In addition to state funds, Robert Rodriguez has long had use of the state & city funded studios based at the former Austin airport. His Troublemaker Studios utilizes the Austin Studios facilities, which is managed by the Austin Film Society. Are racial-revenge fantasies the intended use of such publicly and community supported institutions?

Record U.S. Home Foreclosures In 2009 : Expected Increase Of 3 Million More Homes To Be Repossessed For 2010 By Greedy Banks!

A record 2.82 million homes faced foreclosure foreclosed in 2009, according to RealtyTrac, a web-based firm that tracks and markets foreclosed homes. It is anticipated that at least 3 million more homes will enter foreclosure in 2010.

Last year saw an increase of 21 percent in the number of homes in foreclosure from 2008, in spite of President Barack Obama’s much-vaunted “housing rescue.” In all, 1 in 45 US homes was subject to at least one foreclosure filing, or 2.21 percent of all homes, compared with 1.84 percent in 2008, 1.03 percent in 2007, and 0.58 percent in 2006, according to RealtyTrac’s “Year-End 2009 Foreclosure Market Report.” The report compiles the number of separate homes that received default notices, faced foreclosure auctions, or were repossessed by banks.

The new year is expected to be worse. “As bad as the 2009 numbers are, they probably would have been worse if not for legislative and industry-related delays in processing delinquent loans,” said James Saccacio, CEO of RealtyTrac. Saccacio cited a series of factors that contributed to delaying foreclosures in 2009, among them trial loan modifications, state legislation lengthening the foreclosure process, and the sheer volume of inventory “clogging the foreclosure pipeline,” as MarketWatch put it.

“In the long term, a massive supply of delinquent loans continues to loom over the housing market, and many of those delinquencies will end up in the foreclosure process in 2010 and beyond, as lenders gradually work their way through the backlog,” Saccacio said.

The trend for 2010 may have been anticipated by the sudden increase in foreclosure filings in December 2009. Foreclosures that month increased by 14 percent from November 2009 and 15 percent from the previous year.

Banks repossessed a record 918,000 homes last year, a 6.5 percent increase over 2008. This number could increase rapidly, with 1 million more homes in the process of foreclosure and by 5.5 million currently-delinquent mortgages. The consequences for home values—the major source of wealth for most US families—when these properties enter the housing market will be severe. Home prices have already fallen by 30 percent since October 2006, according to the Case-Schiller Index.

“The doomsday prognostications say that gives you 7 million properties that are all going to go back to the banks, that are all going to hit the market at the same time and we’re going to have a smoking crater where there used to be a real estate market,” Sharga said, adding that RealtyTrac expects a less catastrophic, but still bleak, situation. “Because of gradual foreclosure bank sales we’re looking at a long, slow, flat housing market recovery that probably won’t feel much better until about 2013,” he said.

The Sun Belt states of Nevada, Arizona, Florida, and California continued to lead in foreclosure rates. In Nevada, more than 10 percent of all housing units were in the process of foreclosure in 2009; in both Arizona and Florida the figure was about 6 percent. In California, 632,573 homes received a foreclosure filing in 2009, or 4.75 percent of all homes, just under 1 in 20.

A number of other states had foreclosure rates above the national average of 2.2 percent, or more than one in every fifty homes. These include Utah (2.93 percent), Idaho (2.72 percent), Georgia (2.68 percent), Michigan (2.61 percent), Illinois (2.50 percent), and Colorado (2.37 percent).

The latest foreclosure statistics are indisputable proof that President Obama’s “Making Home Affordable Act,” launched in March, has done nothing to lessen the housing crisis. The $75 billion program offered banks rich incentives to renegotiate payment plans, but ruled out reductions in mortgage principal, or outstanding loan balances. The banks refuse to take any loss on these vastly overvalued loans.

“Until the lenders start to get into principal balance reduction you’re going to continue to see high redefault rates,” Rick Sharga, senior vice president at RealtyTrac, said. “We haven’t seen any appetite for that on the part of the lenders yet.”

The RealtyTrac data is the latest to suggest the “housing recovery” has fallen flat. The National Association of Realtors reported in early January that future home sales—contracts agreed upon but not finalized—fell by 16 percent in November, more than three times what economists had anticipated.

Driving the foreclosure crisis is the impoverishment of broad sections of the US population through unemployment and pay cuts.

First-time jobless benefit claims rose unexpectedly this week, by 11,000 to 444,000. Some economists took cheer from the fact that the four-week moving average for first-time benefit seekers fell to 440,750, the lowest figure since August 2008. For these statistics to demonstrate a meaningful improvement in the jobs crisis, however, there would have to be evidence of increased hiring or job availability. This is not the case.

The Labor Department reported Tuesday that the number of job openings fell again in November by 100,000 positions, to 2.4 million. With more than 15.3 million people out of work and looking for a job, the ratio of job seekers to open positions was greater than six to one, the largest differential on records dating back to December of 2000. Counting the unemployed and underemployed, the ratio balloons to 11 to 1. The pace of hiring also remained at lows not seen since data collection began ten years ago.

On January 8, the Labor Department announced that the US economy lost 85,000 jobs in December. The unemployment rate stayed above 10 percent, while the broader “U-6” measure of unemployment increased to 17.3 percent, as 661,000 workers fell out of the labor force. The same day, United Parcel Service (UPS) and defense contractor Lockheed Martin announced 1,800 and 1,200 job cuts.

In the intervening week, layoff, job cut, and pay reduction announcements continued.

On Friday, Universal Music Group announced 50 layoffs. The bankrupt recycled paper concern, Smurfit-Stone Container Corp., said it would close four more plants and cut 600 jobs this year.

On Thursday, Louisiana State University administrators revealed that they intend to lay off “several hundred” non-tenured instructors over the next year, and Southeast Missouri State University said it will dismiss 24 workers by the end of the school year. The same day Chicago law firm Seyfarth Shaw laid off 40 lawyers and staff.

On Wednesday the submarine manufacturer Electric Boat, a subsidiary of General Dynamics Corp., announced that it will lay off between 400 and 600 workers and force as many as 200 furloughs in the coming months. Primarily affected will be waterfront workers at shipyards in Connecticut and Rhode Island.

On Tuesday, the Riverside County (California) Board of Supervisors said that hundreds of county workers will be laid off or forced out over the next two years in order to meet its budget deficit.

On Monday, the internet firm AOL began laying off 1,200 workers as part of 2,300 total job cuts, and pharmaceutical giant Pfizer began sending layoff notices to 680 workers made redundant by its acquisition of rival Wyeth.

Workers who still have jobs are facing declining wages. The Labor Department reported this week that inflation-adjusted weekly earnings fell by 1.6 percent in 2009, while a broad measure of inflation, the consumer price index (CPI), rose by 2.7 percent. Inflation was paced by energy prices, which jumped by 18.2 percent in 2009, the steepest increase since 1979. Gasoline prices recorded a record increase of 53.5 percent.

Amidst layoffs, wage cuts, rising prices, and rapidly deteriorating home values, consumers continue to cut back on spending. The US Commerce Department reported on Thursday that retail sales fell by 0.3 percent in December, startling economists who had widely expected an increase. For the year as whole, retail sales were down 6.2 percent over 2008, the worst decline on record.

The decrease in retail sales is likely to exacerbate the broader crisis. Consumer spending, a substantial proportion of which is retail sales, accounts for approximately two-thirds of US gross domestic product and is a major source of tax revenue for state and local governments.

PHOENIX – Authorities have captured 17 suspected illegal immigrants in southern Arizona as they continued their manhunt Saturday for smugglers who they say shot and wounded a sheriff’s deputy in a remote desert area 50 miles south of Phoenix.

Three of those captured overnight Friday matched descriptions from the wounded Pinal County deputy and were being questioned Saturday, sheriff’s Lt. Tamatha Villar said. The deputy was released from the hospital, and was recovering at home…

Arizona politicians called Friday’s shooting an outrage and urged the federal government to do more to secure the U.S.-Mexico border.

The violence “should show the rest of the country what we Arizonans have known for too long — the unsecured border poses a very real and very immediate danger,” said U.S. Rep. Ann Kirkpatrick, a Democrat whose district includes part of Pinal County.

On Friday afternoon, Deputy Louie Puroll, 53, was patrolling near Interstate 8 when he came upon a stash of marijuana bales and five suspected smugglers. At least one of the suspects opened fire on him, tearing a chunk of skin from his back.

Puroll radioed in that he was shot, setting off a frantic hour-long search for the deputy in the remote desert, Villar said.

The area is a well-known smuggling corridor for drugs and illegal immigrants headed from Mexico to Phoenix and the U.S. interior.

State and federal law enforcement agencies deployed helicopters and scores of officers to search a 100-square-mile zone for the suspects. The Arizona Republic reported that officials said more than one of the choppers came under fire during the manhunt on Friday.

Puroll, a 15-year department veteran, had been on the lookout for smugglers when he discovered the suspected smugglers, two armed with rifles, authorities said.

Graham County Sheriff Frank Hughes was shot when he pulled over to look into a disabled vehicle.

The sheriff had reached into his own vehicle, possibly to get a flashlight, when the motorist walked up behind him with a .410-gauge shotgun and pointed it at the sheriff’s face.

They struggled and Hughes managed to pull the gun down toward his body before the gunman fired, Graver said.

The sheriff’s bulletproof vest absorbed the brunt of the shotgun blast.

“He’s doing fine,” Graver said.

The sheriff was able to return fire but there was no indication if his attacker was hit.

Two people driving down the road found the sheriff lying on the ground moments later.

Graver said there was no other traffic in the area in southeastern Arizona when the shooting occurred.

A spokeswoman for the sheriff’s office in nearby Cochise County, Carol Capas in Bisbee, said police were on the lookout for a sedan occupied by a man and a woman.

Hughes, 53, was treated at Mount Graham Regional Medical Center and was expected to be released Tuesday.

“We’re extremely grateful,” said Terry Cooper, manager of the rural southeastern Arizona county, which has a population of about 35,000. “Sheriff Hughes is one of the good guys of the world. He cares deeply about our community.”
