These are the opening lines that under our constitutional system, the American people, not government bureaucrats, are sovereign.
Ronald Reagan was right when he said that America is a nation that has a government — not the other way around.
Congress Has the Power to Protect the Constitution. It Should Use It.
President Obama cannot bind the American people to job killing international agreements on climate change without the advice and consent of the United States Senate.
Similarly, he can’t bypass the peoples’ representatives in Congress by having the EPA pursue the same goals through bureaucratic totalitarianism.
This message to the President is also a message to Congress. Should the Obama Administration act unilaterally and subvert the Constitution, the American people will rightfully rise up in opposition.
Congress has the power to protect its constitutional role and protect the people’s voice in how we’re governed. It should use it.
Substituting the Advice and Consent of the Senate with the Bureaucratic Power of the EPA
The Obama Administration’s various threats to act unilaterally — via the EPA — to achieve his goal, occur against the backdrop of this inescapable fact: The Senate, reflecting the will of the American people, refuses to pass the administration’s job killing cap and trade legislation.
The result is that the administration is preparing to bypass the Senate with its announcement last week that the EPA will regulate carbon dioxide as a dangerous pollutant.
Knowing that it lacks the votes in the Senate to ratify any binding commitment made in Copenhagen to radically lower emissions, the administration may well attempt to use the EPA’s newly asserted power — thus bypassing Senate ratification — to implement the agreement.
This would be a breathtakingly anti-democratic and unconstitutional arrogation of power on the part of the President. But it is exactly what some groups are pressuring the President to do. See this report, “Yes He Can: President Obama’s Power to Make an International Climate Commitment Without Waiting for Congress” by the Center for Biological Diversity Climate Law Institute.
And Congressman Ed Markey (D-Mass.), the co-author of the energy tax in the House of Representatives, stated this past weekend on “Fox News Sunday”, in response to Chris Wallace’s question about whether President Obama could make a binding commitment at Copenhagen, that “without question, the President does have the authority to make a commitment based upon the endangerment finding — that is the authority the EPA will have.”
Such action would be a corruption of America’s constitutional system that the Congress must reverse.
Does Senator Webb Believe the Authority of the EPA Can Substitute for the Authority of the Senate?
Some senators seem to get this. On “Fox News Sunday” last weekend Senator Jim Inhofe (R-Okla.) stated flatly that the President doesn’t have the power to make binding emissions reductions commitments at Copenhagen.
And Virginia Democratic Senator Jim Webb recently wrote an open letter to President Obama in which he warned the President not to make binding commitments at Copenhagen.
“As you well know from your time in the Senate,” wrote Webb, “only specific legislation agreed upon in the Congress, or a treaty ratified by the Senate, could actually create such a commitment on behalf of our country.”
But Senator Webb wrote his letter before the EPA unilaterally declared the government’s right to regulate carbon dioxide.
And so the question must be asked of Senator Webb: Does he believe that the authority of the EPA can substitute for the constitutional authority of the Senate — authority that he has so courageously defended?
Radical Environmentalism Is “The New Socialism”
Columnist Charles Krauthammer calls the shake down occurring in Copenhagen and the EPA’s domestic power grab “the new socialism.”
Following the death of the old socialism with the Soviet empire, writes Krauthammer, “the cultural elites went straight from the memorial service for socialism to the altar of the environment. The objective is the same: highly centralized power given to the best and the brightest, the new class of experts and technocrats. This time, however, the alleged justification is saving the planet.”
And if the question is, “Will the new socialism succeed?” the answer is, “Not if the American people have anything to do with it.”
Last year, the “drill here, drill now” movement succeeded in removing both the executive and legislative bans on drilling offshore to capture American energy.
The American people’s success in “drill here, drill now” opened up a national conversation on freeing America from dependence on foreign dictators for our oil. Americans began to understand and believe that We Have the Power(see Callista’s and my movie on energy of the same name) to safely develop our own energy reserves and technology to achieve energy independence.
Today, American Solutions is issuing a similar rallying cry to the American people.
Our message is that no imperial presidency, no totalitarian bureaucracy, and no global international elite can or will usurp the power of We the People.

Barack says we need to have a conversation about race in America .. Fair enough. But this time, it has to be a two-way conversation.. White America needs to be heard from, not just lectured to… This time, the Silent Majority needs to have its convictions, grievances and demands heard. And among them are these:
First, America has been the best country on earth for black folks. It was here that 600,000 black people, brought from Africa in slave ships, grew into a community of 40 million, were introduced to Christian salvation, and reached the greatest levels of freedom and prosperity blacks have ever known. Wright ought to go down on his knees and thank God he is an American.
Second, no people anywhere has done more to lift up blacks than white Americans. Untold trillions have been spent since the ‘ 60s on welfare, food stamps, rent supplements, Section 8 housing, Pell grants, student loans, legal services, Medicaid, Earned Income Tax Credits and poverty programs designed to bring the African-American community into the mainstream. Governments, businesses and colleges have engaged in discrimination against white folks — with affirmative action, contract set-asides and quotas — to advance black applicants over white applicants. Churches, foundations, civic groups, schools and individuals all over America have donated their time and money to support soup kitchens, adult education, day care, retirement and nursing homes for blacks.
We hear the grievances.
Where is the gratitude??
Barack talks about new ‘ladders of opportunity’ for blacks. Let him go to Altoona ? And Johnstown , and ask the white kids in Catholic schools how many were visited lately by Ivy League recruiters handing out scholarships for ‘deserving’ white kids..? Is white America really responsible for the fact that the crime and incarceration rates for African-Americans are seven times those of white America ? Is it really white America ‘s fault that illegitimacy in the African-American community has hit 70 percent and the black dropout rate from high schools in some cities has reached 50 percent?
Is that the fault of white America or, first and foremost, a failure of the black community itself?
As for racism, its ugliest manifestation is in interracial crime, and especially interracial crimes of violence. Is Barack Obama aware that while white criminals choose black victims 3 percent of the time, black criminals choose white victims 45 percent of the time?
Is Barack aware that black-on-white rapes are 100 times more common than the reverse, that black-on-white robberies were 139 times as common in the first three years of this decade as the reverse?
We have all heard ad nauseam from the Rev. Al about Tawana Brawley, the Duke rape case and Jena . And all turned out to be hoaxes. But about the epidemic of black assaults on whites that are real, we hear nothing.
Sorry, Barack, some of us have heard it all before, about 40 years and 40 trillion tax dollars ago.
This needs to be passed around because,
this is a message everyone needs to hear!!!

President Obama enjoys comparing himself favorably to his predecessor. As a candidate he called the Bush Administration “one of the most secretive, closed administrations in history.” As President, Obama has pledged “an unprecedented level of openness in government.”
Unless, that is, you want to voice your opinion as a citizen on whether we should reduce America’s dependence on foreign oil by developing offshore oil and gas reserves.
Whether you’re pro or con, if you want to comment on offshore drilling, the “Yes, We Can” Obama Administration has a simple, three-word answer for you:
No, you can’t.
The Bush Interior Department Was Open to Public Comment (Pro and Con) on Drilling
This is change alright, but not the good kind.
Last July, you may remember, President Bush rescinded the 18-year-old executive ban on offshore drilling in order to access the estimated 115 billion barrels of oil on the outer continental shelf.
The elimination of the ban kicked off a regulatory process at the Interior Department to determine where to drill. The public was invited to comment.
As part of the “Drill Here, Drill Now” campaign, American Solutions put out the call to supporters of responsible offshore drilling to make their voices heard.
The “Drill Here, Drill Now” Campaign Was a Success of Citizen Activism
The process was simple. From AmericanSolutions.com, it was just two clicks on the computer to the government officials who were determining where the new oil and gas leases would be located.
Just two steps.
The response was overwhelming. From American Solutions alone, nearly 40,000 Americans used this simple, online process to let Bush Interior Department officials know they supported safe offshore drilling. In the end, supporters of responsible domestic energy production won the comment period by a margin of 86,000 to 79,000.
And Congress responded to this outpouring of citizen support in September by letting its own moratorium on drilling expire.
The Administration That Has Promised “Unprecedented Openness” Won’t Provide an Email Address for Public Comment
So where are we today? The government has created a proposed list of offshore leasing sites, including off the coasts of Virginia, North Carolina, South Carolina, Georgia and California.
And because public comments will be central in determining the fate of this plan, American Solutions once again developed a quick and easy way for Americans to weigh in online. Just go to www.yourenergyopinion.com. Enter your name, your address, and your email. Then hit “send.”
But just as soon as we were about to open this window, the Obama Administration slammed it shut.
The government that has pledged itself to “unprecedented openness” and “collaboration” with the American people has refused to provide a government email address to forward public comments to.
Instead of a Simple Email Address, You Have to Follow a Hopelessly Complicated, Ten-Step Process
Instead of this simplified process, citizens have to undertake a hopelessly complicated, difficult to follow, ten-step process that goes like this:
1. First go to http://www.regulations.gov. Notice that there is no link on that page about submitting comments on offshore drilling.
2. Instead, the next step is to click the link next to “Advanced Docket Search” under “More Search Options.”
3. Then, you have to click the drop-down menu labeled “Agency” and select “Minerals Management Service.”
4. Then, if you aren’t frustrated enough by this tedious process, you have to manually enter the identification code for offshore drilling. How do you find that? Go to the Department of the Interior and look at the Minerals Management Website.
5. Once you’ve found the code — the easily memorized “MMS-2008-OMM-0045” — go back to www.regulations.gov and enter it into the “Docket ID” box.
Fed up yet? You’re only halfway there.
6. Click “Submit” and wait for the system to retrieve the right regulation for you to comment on. Hopefully you entered the 16-character code correctly or else you will have to start over.
7. If you entered everything correctly, you have to click the link for the code you entered. That code again is “MMS-2008-OMM-0045.”
8. Then, you will probably see a list of results (although the system doesn’t work correctly every time and sometimes you have to resubmit everything.) In those list of results, at the top of the list is the docket ID “MMS-2008-OMM-0045-0001.” Click the yellow balloon under “Add Comments” on the same line as that ID. (Notice, too, that the ID you are commenting on isn’t even the same complicated code that you had to enter to get to this page.)
9. If you still have enough patience, fill out all of the required fields.
10. Finally, submit your comments to the Department of Interior about offshore drilling.
To Make Your Voice Heard on the Environment…You Must Hurt the Environment
Of course, if you really want to have your voice heard on offshore drilling, you could use one of the other options made available by the Obama Administration:
1. Write your opinion down on paper and spend the time and the postage it takes to use snail mail.
2. Write your opinion down on paper and travel to Virginia and deliver your comments in person.
3. Travel to one of four town meetings and hope you get called on.
Some would argue that all of these options are less cumbersome than using www.regulations.gov, but all of them are less ‘green’ than a paperless email system.
The irony: Being forced to hurt the environment to voice your opinion on the environment.

If President Obama really wants to have the most open government in American history, he should allow citizens to email their comments on offshore drilling.
It won’t necessarily distinguish him from his predecessor, but it would be the right thing to do.

For those of you who have forgotten your Latin, it means “deeds, not words.”
There’s been a lot of overheated rhetoric about health care reform, but this saying is one that all Americans should return to when considering plans for a government-dominated health system.
In other words, we should judge government, not by its words, but by its deeds.
With this simple principle in mind, what follows are three examples why government can’t – and shouldn’t – run our health care system (at least not any health care system you or I would want to be dependent on).
Every family knows about making a budget and living within its means. Government, to put it bluntly, does not.
What if your husband had come home last Friday night and announced that he had racked up almost 30 percent more debt on the family credit card – including the mortgage and car loans – than he had told you about just a month ago?
Would you trust him to go out and start spending money to remodel the kitchen? And do you think he could get a loan to do it?
But that’s exactly what the Obama Administration did with their weekend news dump. They announced late Friday that the amount of money they don’t have but are nonetheless planning on spending over the next ten years isn’t the astonishing $7 trillion they estimated in May but is instead an astounding $9 trillion.
Add this to the fact that, after the administration sold its health care reform proposal on the grounds that it will reduce costs to the Treasury, the independent Congressional Budget Office determined that the House plan will actually cost an astounding $1 trillion-$1.5 trillion in the next ten years, which will be added directly to the federal debt. The director of the CBO testified before Congress last month that “[i]n the legislation that has been reported we do not see the sort of fundamental changes that would be necessary to reduce the trajectory of federal health spending by a significant amount. And on the contrary, the legislation significantly expands the federal responsibility for health care costs.”
Which do you have more faith in, the government’s happy talk of “bending the cost curve” or its record of out-of-control spending?
Deeds, not words.
As the inimitable Andy McCarthy of National Review put it, “Compared to the infinite complexity of healthcare and health-insurance, cash-for-clunkers is kindergarten stuff. You trade in your old car for a new one that gets (slightly) better mileage and the government gives you money – between $3,500 and $4,500. How hard is that?”
Too hard for government bureaucrats, it turns out.
Transportation Secretary Ray LaHood has boasted that the cash-for-clunkers program provided “a lifeline to the automobile industry, jump starting a major sector of the economy and putting people back to work.”
But look at the deeds, not the words.
