In a quick turn of events, Republican state senators in Wisconsin have successfully pushed through a provision stripping public employees of their collective bargaining rights by separating it from Gov. Scott Walker’s controversial budget bill.
The stand-alone measure passed Wednesday evening by a vote of 18-1. No Democrats were present.
In effect, the vote renders Democrats attempts to withhold the provision from the budget bill moot.
With the bill’s most controversial provision removed, Republicans hope Democrats will now return to continue the debate of the rest of the budget proposal.
As you’ll recall, all 14 state Senate Democrats fled the state in an attempt to prevent passage of the budget bill. With the collective bargaining provision included in the budget bill, the GOP needed at least one Democrat to be present for a quorum to allow a vote. But with the provision voted on as a stand-alone measure, the GOP successfully passed the policy with no Democrats present.
The collective bargaining provision was put into its own bill hastily created during a joint conference committee Wednesday. Senate Majority Leader Scott Fitzgerald shepherded the bill through the process as Democratic Rep. Peter Barca objected, claiming the committee‘s meeting was in violation of the state’s open meetings law.
At press time, Senate Democrats were reportedly meeting to decide how best to respond to the GOP’s decisive action.
The Senate-passed stand-alone provision now heads to the state Assembly for approval.
As the Senate voted Wednesday evening, demonstrators gathered at the state capitol building erupted in a roar of protest. Spectators in the Senate gallery screamed “You are cowards.”
Before the sudden votes, Democratic Sens. Bob Jauch said if Republicans “chose to ram this bill through in this fashion, it will be to their political peril. They’re changing the rules. They will inflame a very frustrated public.”
Senate Democrats have been absent from the state for three weeks. Sen. Matt Miller, leader of the Senate Democrats, quickly issued the following statement after the vote:
In thirty minutes, 18 State Senators undid fifty years of civil rights in Wisconsin. Their disrespect for the people of Wisconsin and their rights is an outrage that will never be forgotten. Tonight, 18 Senate Republicans conspired to take government away from the people. Tomorrow we will join the people of Wisconsin in taking back their government.
Senate GOP leader Fitzgerald issued his own statement:
“Enough is enough.“ ”The people of Wisconsin elected us to do a job. They elected us to stand up to the broken status quo, stop the constant expansion of government, balance the budget, create jobs and improve the economy. The longer the Democrats keep up this childish stunt, the longer the majority can’t act on our agenda. [...]
“We have confirmed with the Legislative Fiscal Bureau, the Legislative Council and the Legislative Reference Bureau that every item in tonight’s bill follows the letter of the law.
“The people of Wisconsin elected us to come to Madison and do a job. Just because the Senate Democrats won’t do theirs, doesn‘t mean we won’t do ours.”
UPDATE:
Gov. Scott Walker is praising Republicans for moving forward with his proposed budget provisions. Democrats were offered repeated opportunities to come home and negotiate, Walker said, but they refused.
“In order to move the state forward, I applaud the Legislature’s action today to stand up to the status quo and take a step in the right direction to balance the budget and reform government,” Walker said.
The AP is reporting that Democrats are planning their return to the state, but Democratic Sen. Jon Erpenbach tells local affiliate NBC15 that despite reports, the Senate Democrats do not plan to return to the state tonight or tomorrow.
Meanwhile, Democratic Sen. Chris Larson told MSNBC‘s Lawrence O’Donnell: “If [the GOP] wanted us back, they could have had us back. We’re getting together to see what legal action can be taken. They’ve been sloppy in their haste trying to get this done. But the story is where the Republicans are…[not with] the people. They’ve proved themselves to be deceptive. Special interests over people. Shutting down public debate, public hearings, the phone lines, the capitol, our offices, and now this. There’s no low they won’t go to to kill workers’ rights. Untrustworthy, can’t keep their word. We asked for negotiations. They used the letter as a prop in a press conference… shows where they are, where they’re at. They’re passing things w/o the public being aware of them. I doubt if many in WI have heard what happened. A lot of people will step out to the streets to recall…“
The community organizer who became president has launched a massive pre-reelection year campaign to assemble and train an army of new community organizers to carry Obama’s “movement forward for years to come.”
Scott Walker, the governor of Wisconsin, announced an assault against state workers last Friday, eliminating collective bargaining rights and threatening to fire workers who go on strike. The plan would divert 5.8 percent of workers’ pay to the state pension fund, and an additional 12.6 percent of their pay to employee health care premiums.

Rangel, facing ethics charges in Congress, has proposed the Universal National Service Act that would require “all persons” from ages 18-42 “to perform national service, either as a member of the uniformed services or in civilian service in furtherance of the nationaldefense and homeland security.”

CHARLIE RANGEL (D., N.Y.): He is being “investigated by the House Ethics Committee in at least four areas, including his reported failure to properly report income taxes on a Caribbean villa in the Dominican Republic; use of four, rent-controlled apartments in Harlem; questions about an offshore firm asking Rangel for special tax exemptions; and whether Rangel improperly used House stationery to solicit donations for a school of public affairs named after him at City College of New York,” Fox News summarizes.
The plan also authorizes “the induction of persons in the uniformed services during wartime to meet end-strength requirements of the uniformed services, and for other purposes.”
“May Obama be d—–,” he wrote. “It reinstitutes the draft, and is for both males and females … There is no ‘opt-out’ – if you are not ‘fit’ for actual military service, or are a ‘conscientious objector,’ then you are shunted into ‘civilian service’ which is pretty much anything the ‘president’ says it is.”
WND reported when a copy of Obama’s Colorado Springs speech posted online apparently was edited to exclude Obama’s specific references to the new force.
According to the copy of Rangel’s plan, which has been assigned to the Subcommittee on Military Personnel even though it lacks cosponsors, it specifies that “national service” means “military service or service in a civilian capacity that, as determined by the president, promotes nationaldefense, including national or community service and service related to homeland security.”
“It is the obligation of every citizen of the United States, and every other person residing in the United States, who is between the ages 18 and 42 to perform a period of national service as prescribed in this title,” it specifies.
It would require that the president provide “for the induction” of people to the service corps.
“Except as otherwise provided in this section, the period of national service performed by a person under this title shall be two years,” Rangel wrote.
The exceptions provide that the term of service may be extended if the “member” needs to “compensate for any time lost to training for any cause” or “for the purpose of furnishing hospitalization, medical, or surgical care for injury or illness incurred in the line of duty.”
It gives the president the far-reaching authority to “prescribe such regulations as are necessary to carry out this title,” including what types of “civilian service” are required, “standards of satisfactory performance,” “penalties for failure” and “such other matters as the president determines necessary to carry out this title.”
Conscientious objectors would be ordered “to perform national civiliain service … as the president may prescribe.”
The group Operation Sit In said it is coordinating information to link up those who “have the time to go to D.C. at the drop of a hat to keep the Senate from passing the Universal National Service Act … with those who would like to go to stop it, but cannot afford to lose their jobs by taking off with no notice.”
National Director Larry Richardson said, “Most of those who have the time and freedom of time to go are out of work because of the current economy, and therefore are short on funds to go. So we match those who still have jobs with those who do not, and with everyone doing a little, no one has to do it all.
“We also are arranging for people who live fairly close to D.C., (within 50 or so miles), to let us park our cars on their property, at home or business, so we do not have to worry about them being towed while we are in D.C.,” he said.
“We need every PATRIOT to step up and help in this,” he said.
A spokesman for Rangel’s office, Emile Milne, told WND that nobody knows what such a plan would cost, but presumably those in full-time service to their country as civilians would have to be paid, how many people would be conscripted or other details.
“It would have to move through committee,” he said. “These questions … certainly would be addressed by the relevant committee.”
He said the discussion in Rangel’s office is that those in the civilian corps would work in “education, health care, they could work in our ports, various aspects of security.”
He also said the idea has been a long-term goal for Rangel.
WND reported earlier when Obama signed into law the “GIVE Act,” H.R. 1388, which massively expands the National Service Corporation and allocates to it billions of dollars.
Officials said at that time the law would allow for the “managing” of up to 8 or 9 million people.
That bill includes a “National Service Reserve Corps” whose members have completed a “term of national service,” “training” and “not less than 10 hours of volunteering each year.”
Joseph Farah, founder and editor of WND, used his daily column when the issue originally arose to alert Americans of the plans. He then elevated the issue with a call to all reporters to start asking questions.
“If we’re going to create some kind of national police force as big, powerful and well-funded as our combined U.S. military forces, isn’t this rather a big deal?” Farah wrote. “I thought Democrats generally believed the U.S. spent too much on the military. How is it possible their candidate is seeking to create some kind of massive but secret national police force that will be even bigger than the Army, Navy, Marines and Air Force put together?
“Is Obama serious about creating some kind of domestic security force bigger and more expensive than that? If not, why did he say it? What did he mean?” Farah wrote.

On September 17, 1787 George Washington was the first to sign and accept the Constitution even though it had no Bill of Rights. It was Patrick Henry with his great speeches and lectures who in 1788 forced an agreement which promised that continued ratifica- tions of the document depended upon a Bill of Rights to be forthcoming. In 1789 Washing- ton took office and was faced with the arduous task of pioneering the first presidency including the structuring of the militia system. By January 1790 the influence Patrick Henry had over him became quite apparent. When Washington chaired the 1787 Constitutional Convention, provi- sions had been made for the defense of the country against invasion and for stifling rebel- lions, but there was an insuf- ficiency of safeguards to be applied against tyranny brought on by public officials.
By 1790 Washington began work on his “Plan No. 2 for the Organization of the Militia.” By now he was more able to see the weaknesses in the Constitution. He openly discussed the threat of tyranny emanating from within the government. By then, Patrick Henry’s wisdom was spread throughout the 13 original states, and it was inculcated as the basis for the policies and functions of the militia. Henry perpetuated the people’s liberty. He sustained the ultimate authority of the people. Washington well under- stood the need to safeguard the nation from its foreign enemies. In his “Plan No. 2 for the Organization of the Militia” he

undertook to warn about the dangers of domestic enemies: tyranny in government.
Washington himself took the farmers out for practice, and he utilized the knowledge and experiences of his generals and other valuable officers in the War for Independence by having them instruct and train the citizens (the whole people) in the techniques of soldiering, and the maintenance of an ‘energetic national militia’.
His “Plan No. 2 for the Organization of the Militia” was communicated to the Senate, on the 21st of January 1790. This lengthy Plan was permeated with the proposition that it is the direct duty and responsibility of the people themselves to guard against tyranny from within government.
Washington declared that the purpose of the militia was “to oppose the introduction of tyranny.” He had come a long way from the days when he accepted the Constitution without a Bill of Rights.
To view Washington’s statement in the context in which it was delivered, please look over the following excerpt taken from Pages 7-8 of an old document published by Gales and Seaton in 1832 entitled “American State Papers – Documents, Legislative and Executive, of the Congress of the United States, from the First Session of the First to the Second Session of the Fifteenth Congress, inclusive: commencing March 3, 1789, and ending March 3, 1819”.
This excerpt is a part of Wash- ington’s lengthy Plan No. 2 of 1790. While he also made re- ference to the prevention of invasion and rebellion, Washing- ton said that “the well informed members of the community (the people) were meant to be the real defence of the country”; and “the virtues and knowledge of the people would effectually oppose the introduction of tyranny.”
He warned that “the government would be invaded or overturned, and trampled upon by the bold and ambitious” — meaning people in our own country who operated without adherence to vital principles. The absoluteness of the right of the people to keep and bear arms is a basic principle. Unless the right to arms is absolute, the people cannot remain the ultimate power. The Bill of Rights confirmed that we possess many other rights beside the absolute right to arms. All of the other rights for the preservation of their own existence, depend entirely upon the absoluteness, the force, and the reasoning that have shaped the Second Amend- ment. Washington agreed with Patrick Henry on the purpose of the militia: It was to “oppose the introduction of tyranny.” Make no mistake about it: The prime reason for the Second Amend- ment is prevention of tyranny in government.
What African Thanked The Hand Of This White Family For Dying And Suffering For their Freedom Under President Abraham Lincoln, The First Republican President Of the United States?
Though known for his work during the Harlem Renaissance and rightfully lauded for his voice during the Civil Rights movement, and though he denied it personally, Langston Hughes was a Communist. Hughes traveled on a few occasions to the USSR, supported Joseph Stalin’s murderous purge of Communist Party detractors, and lent his celebrity and personality to groups like the Scotssboro Boys, the John Reed Clubs, and the League of Struggle for Negro Rights here at home. Hughes was like a great number of politically-active African Americans back then, looking to the socioeconomic politics of the Soviet Union at that time as an alternative to a segregated America.
[It kind of makes you wonder about the underpinnings of the current administration and those who shaped it, but that's an argument for another time and place. --Jeff]
Hughes’ poem, Let America Be America Again, in which he wrote about the dreams, struggles and realities of black America, was embraced by socialist and communist groups like the International Workers Order, and even by Massachusetts Sen. John Kerry’s doomed presidential campaign in 2004. Undoubtedly, such an adoption and embrace stemmed from passages like this one, which appear a little later than the selection which began this post:
I am the poor white, fooled and pushed apart, I am the Negro bearing slavery’s scars I am the red man driven from the land, I am the immigrant clutching the hope I seek — And finding only the same old stupid plan Of dog eat dog, of mighty crush the weak.
Understanding the connotations of the rest of Hughes’ poems–and poetry–I prefer to look at the first of the two selections, the one with which I began. I prefer to reinvent Hughes’ reality, if I may dare to do so.

Hughes says “[l]et America be the dream the dreamers dreamed.” For so long, it is the American political left which contends that we have only allowed America to be the dream of the few and of the powerful, that it is the very ideology embraced by people like Langston Hughes which would provide respite for the downtrodden and average American alike. Now, however, with the manifestation of that ideology on the horizon, we have cast aside the dreams of the average American to pave way for a “bigger” picture. A picture that is only “big” when it comes to government, and quite narrow when it comes to the American people.
We see the American people rising up and telling their government “NO!” again and again only to be served with the burden of more government in their lives. Today, a revolution is brewing in America, where the voice of the people will surely conquer the conquest of the few and a new vision is bound to unfold.
Tomorrow, we will not see world peace. Tomorrow, we will neither see the end of natural disasters nor those unnatural disasters brought on by the bloody implementation of fanaticism. Tomorrow, however, we do have opportunity. We have the opportunity to have government work responsibly for the people and not against us. We have the opportunity to give the American people a voice, but the path to this is surely less traveled.
In order to have a voice in the government, we must do what our forefathers did and raise our own. We must tell our elected officials that we do not want a government intervention in our lives. Not when it comes to health care, not when it comes to personal spending, and certainly not when it comes to family.
And we’re doing it. President Barack Obama’s health care fiasco has begun to hit a number of potholes en route to an unprecedented government expansion, potholes caused by the American people rising up and explaining to their elected officials that the American people will remain silent no more. At the health care town hall meetings, the American people caused both members of Congress and Senate to reconsider President Obama’s health care agenda and, with the same veracity and an even brighter fate, we must find the resolve to not only cause our elected officials to rethink their relationship with the people in this democratic republic, but surely to reinvent it altogether. The concept of representation, it seems, does not come easily to these people. And that’s not all they need to reinvent.
We must push our elected officials to reinvent more than a national deficit, and indeed reinvent their national vision. Langston Hughes and so many like him sought the respite of communism because he felt that true representation could not be had in his America. And while the stain of communism has certainly left its mark upon the world, Hughes’ feeling that “[w]here never kings connive nor tyrants scheme/that any man be crushed by one above” could be seen not only in the light of class warfare, but in the light of the struggle in which ordinary America–not black America, not white America–is currently entrenched against the ruling class in Washington, D.C.
That American vision, inspired by a people aware of its history and inclemently fighting for its future, is what Ronald Reagan rose to champion, and what Barack Obama has continued to fight against.
Once we have seized the opportunity and have made our voice, vision and values clear, the path does not end there. We must pursue our politicians keeping them accountable to the new American Vision, and furthermore the American people. Recreating the successes of 1994 and 2000 is one thing, but maintaining the message by which we achieved such victory is another. We must remove the façade our politicians have facilitated to keep us out, and make it perfectly, unabiguously clear that We The People are here to stay. It’s time to take back American politics by getting rid of career politicians and electing the common American to serve their country.
For that, I propose a three-step process. It’s as simple as one-two-three or, better yet, U-S-A:
Us: We need to raise our voices and make our new American Vision clear. In reality, it’s not so much a new American Vision, either, but rather an old one, the same one on which this nation was founded. Representation. Freedom. Liberty. E Pluribus Unum.
Standard: We need to pursue our politicians, deny them the status quo, and perpetuate the new standard of People Above Politics.
Act: It’s also time that we elect the average American to office, put the “service” part back into “public service,” and allow true public service to re-enter politics.
Langston Hughes was thought by many to be a racial chauvinist, and as America moved closer and closer to a truly integrated society, his writings were perceived by many to carry less and less weight. Yet those few lines of Let America Be America Again stick out in my mind, highlighted from the rest. As unconventional as his worldview may have been, and as different as his course may have been in getting there, it was nonetheless an American dream that Hughes sought for African Americans.
Like Hughes, Martin Luther King, Jr.–a Republican, by the way–also had a dream. And it was his dream that changed the American attitude toward race, that let us pursue a future for America where the stroke of justice was written with the understanding of our past, where our foundation is our future and the American people are the dreamers who reinvent tomorrow. In order for ordinary, average Americans to prevail in this current quest for freedom, we must not only look to our past but we must understand it. We must understand the principles which made America what it is, and strive to continue rather than transform them.

Democrat Vice President for an airline employee union — Transport Workers Union, Local 568 – at the Miami International Airport (MIA), was arrested in Miami for narcotics possession and distribution. The suspect also worked at MIA as an airline ramp worker.
The arrest was the result of information developed by U.S. Immigration and Customs Enforcement (ICE) special agents regarding the alleged smuggling and distribution of narcotics at MIA.
Miguel Angel Vento, 43, of Doral, Fla., was arrested during a traffic stop, which resulted in the seizure of cocaine and marijuana that was packaged for distribution.
A subsequent search of his residence resulted in the seizure of additional cocaine and marijuana. ICE and Drug Enforcement Administration (DEA) special agents and detectives of the Miami Dade Police Department (MDPD) also seized narcotics paraphernalia, packaging material and other evidence at Vento’s Miami residence.
“This arrest and narcotics seizure demonstrates ICE’s continuing efforts to focus on the internal threat within aviation security and our critical infrastructure areas,” said Anthony V. Mangione, special agent in charge of ICE’s Office of Investigations in Miami.
“ICE will continue to work with its federal, state and local partners at Miami International Airport to deter, disrupt and dismantle groups and criminal organizations that threaten homeland security by smuggling drugs and contraband into the United States.”

Teachers File FEC Complaint against NEA for Illegal PAC Money Laundering Scheme
Sworn testimony indicates union officials misled educators, diverted union treasury funds into political committee
Washington, DC – The National Right to Work Legal Defense Foundation announced today it will file a formal complaint with the Federal Election Commission FEC asking it to investigate charges made by two Alabama educators who discovered a union scheme to divert their money into the National Education Association’s NEA political action committee PAC.
Claire Waites, the chair of the science department, and Dr. Jeanne Fox, an assistant principal, both work at Daphne Middle School in Bay Minette, Alabama. Waites and Fox are both members of the Baldwin County Education Association BCEA, Alabama Education Association AEA, and NEA teacher unions.
In July 2008, Waites and Fox attended the NEA’s annual convention in Washington, DC, as delegates of the BCEA. By telephone, BCEA union president Saadia Hunter informed Waites and Fox that contributions to a “children’s fund” in their names were made from money included in their expense reimbursements for their trip to the convention.
Although Hunter told Waites that these contributions were not political in nature, they actually went to the NEA’s PAC, the NEA Fund for Children and Public Education.
Later, Hunter admitted that the money would be contributed to Barack Obama’s presidential campaign. Sworn statements by Waites and Fox indicate that the AEA union boss also admitted that the PAC contributions were paid with BCEA members’ dues. However, it is illegal for unions to contribute to political candidates using “dues, fees, or other moneys required as a condition of membership in a labor organization.”
Teacher union officials also violated federal law by encouraging and soliciting contributions under false pretenses and without informing Waites or Fox of their right to refuse to contribute without any reprisal. Federal law also forbids campaign contributions made in the name of another person.
“This union money laundering scheme makes a mockery of federal election law,” said Stefan Gleason, vice president of the National Right to Work Foundation, which has joined Waites and Fox as a complainant. “We suspect this scheme was widely used by the NEA union hierarchy and could involve hundreds of thousands of dollars. We urge the FEC to take decisive action.”

Magazine publisher Steve Forbes said Tuesday the proposed Employee Free Choice Act EFCA would eliminate the use of secret ballots in union elections and would bring about forced government arbitration that would remove employers and employees from the contractual negotiation process.
“It’s more of a Soviet-style way of doing union elections,” Forbes said during a conference call news conference. “[It] goes against the grain of American tradition.”
Under current law, workers can vote for or against unionization through a secret-ballot election supervised by the federal government’s National Labor Relations Board.
But under the proposed EFCA (also known as the “Card Check” legislation), if more than 50 percent of employees at a business publicly sign a card, the government would have to certify the union — and a private-ballot election would not take place.
The legislation also says that if a union and employer do not reach a contractual agreement after 90 days, a federal “arbitration panel” will render a “binding” decision to settle the dispute.
Forbes, the president and CEO of Forbes Incorporated, said the EFCA should be referred to as the “Employee Forced Choice Act” because of the strains a government arbitrator would put on American companies, particularly small businesses.
“You would have arbitrators who have no real understanding of small business making decisions on wages, benefits and workplace conditions,” the former Republican presidential candidate said.
Mark McKinnon, vice chairman of Public Services Incorporated, appeared with Forbes at the news conference. McKinnon said he believes the greater the debate and public discussion there is regarding the bill, the smaller the chance it has of being passed.
“It’s clear that this is the most radical re-write of labor legislation in 80 years,” McKinnon said. “It is a nakedly artificial device designed by labor to simply turn around their declining fortunes. It’s a solution in search of a problem.”
McKinnon said the federal arbitration provision should be the major concern because labor groups would see little incentive to negotiate when they would almost certainly receive a better offer from the eventual interference of federal arbitrators.
He also said more businesses are beginning to learn about the provision and are “absolutely horrified” of the effects it would have on the negotiation process.
“What it is at the end of the day is nothing but a hostile takeover by labor of American business,” he said. “It is a labor bailout bill.”
Union and employers are taking turns in bringing top names to champion their sides on the controversial legislation.
Forbes and McKinnon are part of an employer offensive this week on Capitol Hill.
Last week, cast members of the television show “The West Wing” appeared on Capitol Hill along with union leaders and worker advocacy groups to support EFCA.
In an interview with CNSNews TV, actors Martin Sheen and Bradley Whitford said the legislation would not end the use of the secret ballot in union organization efforts and it also would not allow the federal government to dictate employee wages and benefits.
“The notion that the labor movement is out to abolish their own members’ rights to secret ballot just doesn’t pass the laugh test,” Whitford told CNSNews.com. “And people who are propagating the rumor that it does, their sudden compassion for worker’s rights is just not believable.”
But a CNSNews.com review of the bill’s language found that the text thats contradict the actor’s uninformed position.
The bill (H.R. 1409 and S. 560) reads: “If the (National Labor Relations) Board finds that a majority of the employees in a unit appropriate for bargaining has signed valid authorizations designating the individual or labor organization specified in the petition as their bargaining representative and that no other individual or labor organization is currently certified or recognized as the exclusive representative of any of the employees in the unit, the Board shall not direct an election but shall certify the individual or labor organization as the representative described in subsection (a).”
McKinnon, meanwhile, said strategy of labor groups was to push the legislation at the end of President Obama’s 100 days, but he said business groups need to be vocal and active in fighting against the bill.
“They are not going to give up on this,” McKinnon said. “They’re going to find alternative ways. They’re going to use all the pressure. You can see the resources they’re spending during the spring break.
