$11 trillion ‘micromanaging’ price sparks explosion in sovereignty movement
A movement to reclaim for states all rights not specifically designated to the federal government in the U.S. Constitution is exploding across the nation, with 35 states already acting or at least considering such proposals – and one state lawmaker estimating the nation as a whole could save $11 trillion in coming years if it would succeed.WND reported not long ago when the number of states with lawmakers considering such sovereignty efforts reached 20.Now, according to the Tenth Amendment Center,such provisions have been launched in at least 35 states. They all address the Tenth Amendment that says: “powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”

IT BEGINS: BRITISH MONARCHY’S TEA GOES BACK IN THE HARBOR
Rep. Darrell Issa (R.-Calif.), the new chairman of the House Oversight and Government Reform Committee, has signaled he will conduct numerous oversight investigations of the Obama Administration. Here are the Top 10 areas ripe for investigation for Issa and other congressional Republicans:
(1) ObamaCare: Any measure that restructures one-sixth of the U.S. economy bears scrutiny particularly when passage of the bill required legislative bribes such as the Louisiana Purchase and Cornhusker Kickback. To paraphrase Nancy Pelosi, now that ObamaCare has passed, let’s see exactly what is in it — and how it got there.
(2) Stimulus: The American people deserve to know what they got for the $787 billion stimulus package that Obama signed in February 2009, including how much money was spent frivolously to publicize the legislation. And where exactly are all those jobs that the administration claims were “created or saved?”
(3) Freddie and Fannie: Previous attempts by congressional Democrats to get to the bottom of the 2008 financial meltdown conveniently overlooked the role of Fannie Mae and Freddie Mac. How much of the housing crisis was due to financial donations going to Democratic officials, who overlooked financial transgressions at the agencies so long as mortgages flowed to unworthy credit risks?
(4) Wikileaks: Someone in the administration needs to explain how the lowly serviceman who served up secret documents to Wikileaks could have access to such a large amount of classified material. And were any actions taken to shut down Julian Assange in the months after the initial disclosures and before the embarrassing leak of State Department cables?
(5) Climate science: Considering the Obama Administration used concerns over global warming to advance its cap-and-trade energy tax and, via the EPA, regulate carbon dioxide emissions, a hearing on how climate science is impacting public policy is in order.
(6) ACORN: How much federal money was sent to ACORN and what was it used for? That this vote-stealing, partisan group of thugs received tens of millions of taxpayer dollars is an outrage.
(7) Oil spill response: So many questions over the Obama Administration’s response to the Gulf oil spill last April: Why was the response tardy, and did the administration slow local efforts through unnecessary red-tape? Was science politicized with the administration’s rosy estimates over how much oil was left? Were there legitimate concerns or did politics come into play with the decision to impose an offshore oil drilling moratorium?
(8) Justice Department: There are concerns that politics is running amok in the halls of the Justice Department. From undermining national security by trying enemy terror combatants in criminal courts to unequal enforcement of civil rights laws, Attorney General Eric Holder’s shop should be scrutinized. A good place to start is the department’s handling of the New Black Panthers’ voter intimidation case that was dropped.
(9) Czars: While other Presidents have named advisers without congressional approval, Obama has taken the appointment of policy czars to a new level. With appointments going to people like former Green Jobs czar and Marxist Van Jones, Congress needs to know who has been given authority beyond the scope of the Senate’s confirmation process.
(10) Obama’s presidential eligibility: This one should be easy to settle once and for all. Even Hawaii’s Democratic Gov. Neil Abercrombie says President Obama’s birth records should be released. Let’s see what the White House does if a congressional subpoena is issued. For a President who promised transparency, there are an awful lot of his personal documents still under wraps.

MEXICO BEHEADS MORE PEOPLE THAN ALL OF THE MIDDLE EAST COMBINED
The bodies of three men lie together after being placed in the back of a funeral home’s pick-up truck after they were killed by unidentified gunmen in the Pacific resort city of Acapulco, Mexico, Sunday Dec. 5, 2010. At least 11 men have been killed this weekend as authorities say the battle for control of a fractured drug cartel is responsible for the rising violence in Acapulco.
In Afghanistan over 10,000 people died in violent attacks in 2010. The Daily Times reported:
KABUL: More than 10,000 people, about a fifth of them civilians, lost their lives in violence in Afghanistan last year, an AFP count, based on official figures and an independent website tally showed on Sunday.
While Afghanistan’s Interior Ministry spokesman Zemarai Bashary revealed new figures for the number of civilians, police and militants killed in 2010 — a total of 8,560 people. In addition, the Afghan Defence Ministry said that 810 Afghan soldiers died in 2010, while independent website icasualties.org put the total death toll for international troops last year at 711.
That brought the overall number of dead from the war last year to 10,081, according to an AFP calculation. While, last year was the deadliest yet in Afghanistan’s nine-year war for international troops, according to the icasualties tally.
Meanwhile, in Mexico over 13,000 were killed in violent attacks in 2010. The Dallas News reported:
Mexico’s drug violence in 2010 was striking not only for its scale but also for its brutality.
In the northern city of Santiago, the mayor’s body was found with the eyes gouged out. In the picturesque town of Cuernavaca, four decapitated men were hanged from a bridge along a heavily traveled highway. And in Ciudad Juárez this week, two university students were hunted through a maze of streets and killed with bullets to the head, their bodies set on fire.
In 2010, the levels of Mexican violence and the kind of extreme cruelty once reserved for Quentin Tarantino movies reached new heights, not just along the Texas-Mexico border, but in regions that were once spared such bloodshed. More than 13,000 people were killed across the country in drug violence, up from an estimated 9,600 a year earlier.
More… In 2010 over 100 police officers were murdered in the Mexican town of Juarez alone, where the drug-related death toll exceeded 3,100 during that same 12-month span.

COLUMBUS, Ohio (AP) – A judge is allowing Ohio to cancel the registrations of thousands of vehicles largely driven by illegal immigrants.
Monday’s ruling was a defeat for the League of United
Latin American Citizens. The group, which argued that Ohio was illegally
delving into U.S. immigration policy, is considering an appeal.
Franklin County Common Pleas Court Magistrate Pamela
Browning said the state had a compelling public safety interest in canceling questionable
registrations.
Ohio sent notices in October to the owners of more than
47,000 vehicles, informing them that their registrations would be canceled if
they did not provide an Ohio driver’s license, Ohio identification card or
proof of a Social Security number by Dec. 8.
If stopped by police, drivers who can’t provide adequate
identification risk going to jail, with illegal immigrants potentially facing
deportation.
Amid buzz that President Obama may be seeking to parole or “defer action” on millions of illegal aliens in the U.S., eight Republican senators are warning thepresident not to advance any such plan.
“There’s a lot we can agree on when it comes to dealing with the immigration problems in the United States, but this appears to be amnesty in disguise, and is simply an attempt to circumvent Congress,” Sen. Chuck Grassley, R-Iowa, said in a statement.
Grassley and Sens. Orrin Hatch, R-Utah; Saxby Chambliss, R-Ga.; David Vitter, R-La.; Jim Bunning, R-Ky.; James Inhofe, R-Okla.; Thad Cochran, R-Miss.; and Johnny Isakson, R-Ga., signed a letter to the president dated June 21.
“It’s working,” says Farah. “So we’ve got to keep the pressure mounting.”
“The No Amnesty Pledge” has generated more than 100,000 individual letters to senators since it began last month. Additional letters of encouragement are also being sent to Arizona Gov. Jan Brewer, who signed legislation authorizing local law-enforcement agencies to identify illegal aliens.
The anti-amnesty campaign is designed to thwart consideration of “comprehensive immigration reform” in Congress.
Farah says he hopes to emulate the famous “pink slips” campaign that inundated Capitol Hill with nearly 10 million threats to fire members of Congress who, among other things, supported national health care and cap-and-trade legislation.
The senators are now urging Obama for assurance that he has no plans to grant amnesty to illegal aliens. They’ve also requested that he clarify the administration’s intentions immediately.
“The Administration would be wise to abandon any plans for deferred action or parole for the illegal population,” they wrote. “Such a move would further erode the American public’s confidence in the federal government and its commitment to securing the borders and enforcing the laws already on the books.”
“We understand that there’s a push for your administration to develop a plan to unilaterally extend either deferred action or parole to millions of illegal aliens in the United States,” they wrote in their letter. “We understand that the administration may include aliens who have willfully overstayed their visas or filed for benefits knowing that they will not be eligible for a status for years to come.”
The senators agreed that the nation’s immigration laws “need to be fixed,” but they added, “While deferred action and parole are executive-branch authorities, they should not be used to circumvent Congress’ constitutional authority to legislate immigration policy, particularly as it relates to the illegal population in the United States.”

Rick Foster is the Chief Actuary of Medicare, and his office has just released a devastating critique of the Administration’s health reform law.
Before getting to details, let me say there is nothing in the report that is surprising to independent health economists. The conclusions are consistent with everything The Lewin Group and other private estimates have been saying for months. What is surprising is that one of the most respected agencies of the U.S. government is completely undermining the Alice-in-Wonderland fables being spun by the White House, on Capitol Hill and in the mainstream media. To wit:
You cannot take close to one trillion dollars away from one group of people and spend it on another group of people and somehow leave those footing the bill better off.
You cannot give millions of people large increases in medical care without creating any new doctors, new nurses or other paramedical personnel.
You cannot arbitrarily reduce what you are paying providers by billions of dollars and still expect to get the same quantity and quality of care.
You cannot give millions of patients and thousands of doctors new incentives to waste medical resources and then expect health care spending to go down.
In other words, the Chief Actuary is simply saying reality is reality. Economics is economics. A is A.
Health care costs will go up, not down. National health expenditures will increase from 17 percent of GDP now to 21 percent under the new law and will be higher than without the legislation. [Page 4] Net federal spending on health care will also increase.
Health care shortages are “plausible and even probable.” Because of the increased demand for health care, “supply constraints might initially interfere with providing the services desired by the additional 34 million insured persons.” [Page 20]
14 million employees will lose their employer coverage. Employees of small firms are especially at risk (despite small employer tax credit subsidies). [Page 7]
2 million employees who lose coverage will have to enroll in Medicaid. [Page 3]
A Medicaid insurance card is not a guarantee of care. An estimated 18 million people will be added to Medicaid. [Page 3] However, because there is no corresponding increase in the supply of caregivers, “it is reasonable to expect that a significant portion of the increased demand for Medicaid would be difficult to meet, particularly over the first few years.” [Page 20]
One in ten insured workers will see their health benefits taxed. By 2019, more than 10% of insured workers will “be in employer plans with benefit values in excess of the thresholds (before changes to reduce benefits) and this percentage would increase rapidly thereafter.” [Page 13]
Higher taxes will lead to higher premiums. The new taxes on medical devices, prescription drugs, and insurance plans “would generally be passed on through to health consumers in the form of higher drug and device prices and higher insurance premiums.” [Page 17]
There are more than one-half trillion in Medicare cuts. The new health law cuts “$575 billion” from Medicare. [Page 4]
Medicare cuts would threaten almost one in every seven hospitals. About “15 percent of Part A providers would become unprofitable within the 10-year projection period.” [Page 10]
Overall access to care for seniors would go down. Because of the law’s payment reductions, “providers for whom Medicare constitutes a substantive portion of their business could find it difficult to remain profitable and, absent legislative intervention, might end their participation in the program. [Page 10]
7.4 million people will lose access to Medicare Advantage plans. Enrollment in MA plans will be cut in half (from its projected level of 14.8 million under the current law to 7.4 million under the new law). [Page 11]
False advertising: The new “Medicare Tax” doesn’t go to Medicare. “Despite the title of this tax, this provision is unrelated to Medicare; in particular, the revenues generated by the tax on unearned income are not allocated to the Medicare trust funds.” [Page 9]
False advertising:Budgetary double-counting does not improve Medicare’s solvency. Medicare cuts “cannot be simultaneously used to finance other federal outlays (such as the coverage expansions) and to extend the [life of the Medicare] trust fund, despite the appearance of this result from the respective accounting conventions.” [Page 9]
The new long-term care insurance plan (CLASS Act) is unsound. The program faces “a significant risk of failure” because the high costs will attract sicker people and lead to low participation. [Page 15]
The promise to those with pre-existing conditions is unfunded. “By 2011 and 2012 the initial $5 billion in Federal funding for [high risk pools] would be exhausted, resulting in substantial premium increases to sustain the program.” [Page 16]
In what is developing into a standoff between states and the federal government that could be bigger than gun control or even health care, 17 states have launched versions of Arizona’s immigration law, even as federal officials say they may not bother to process illegal aliens caught by the states.
William Gheen, president of Americans for Legal Immigration PAC, which has been trying to get officials to address the open southern border for years, warned the consequences could be dire.
“Over the last couple days, Obama and the chief of ICE have refused to honor their oaths of office,” he said. “Their constitutional requirement is to enforce existing laws.
“They’ve told the American public to go eat cake,” he said.
His organization is assembling the list of state efforts to emulate the Arizona law, which makes it illegal under state as well as federal law to be in the state without documentation.
“Seventeen states are now filing versions of Arizona’s SB 1070, which is designed to help local police enforce America’s existingimmigration laws,” ALIPAC said in a report today.
The report said numerous national and local polls indicate 60 to 81 percent of Americans support local police enforcing immigrationlaws.
“Our national network of activists have been working overtime trying to help the state of Arizona and the brave Arizonans who have passed this bill,” he said. “Arizona no longer stands alone and we have now documented state lawmakers filing, or announcing they will file, versions of the Arizona bill in seventeen states! We will not stop until all states are protected from invasion as required by the U.S. Constitution.”
President Obama several times has said he doesn’t like the Arizona law. He’s called it misguided and ordered a review by the Justice Department.
John Morton, who heads the U.S. Immigration and Customs Enforcement, or ICE, said his agency might not process illegal aliens caught under state jurisdiction, the Chicago Tribune reported.
He insisted that only the federal government should respond to the problem.
“I don’t think the Arizona law, or laws like it, are the solution,” Morton said.
One blogger expressed concern that “a senior Homeland Security official has openly declared that he won’t be doing his job.”
“Morton has sworn an oath to uphold the laws of the United States. He is not allowed to pick and choose which ones he likes and which he doesn’t.”
Gheen said the Arizona law and the plans it has spawned in other states is a victory for Americans. But he said those are just battles, and winning the war will require success in elections this fall.
A “comprehensive” solution to the problem will arrive when there are enough “hostile” members of Congress to tell the administration to uphold the existing immigration and border laws or the impeachments will start, he said.
“[We need to send] to Washington a hostile Congress that is going to encircle the executive branch and tell them to [follow the law] or we’ll impeach all the way down to the speaker of the House,” he said.
Gheen said he is alarmed over the pending release, expected sometime just before the election, of a movie called “Machete,” which reportedly is the story of a Mexican uprising in the United States.
Gheen said the message in the movie reportedly is that Americans will either submit to the “rape” of their land or else.
He said he believes the project is intended to create turmoil just as the mid-term elections draw near.
“There is nothing as important right now as getting [people] fully involved with all the campaigns,” he said.
ALIPAC already has helped to pass some form of immigration enforcement legislation in more than 30 states. And Gheen has developed a national reputation for defeating socially progressive plans to hand out licenses, in-state tuition and other taxpayer benefits to illegal aliens.
“It is incumbent upon our states to protect American lives, property, jobs, wages, security, and health, when the executive branch fails to honor its constitutional responsibility to do so by enforcing our existing border and immigration laws,” he said.
The Arizona law, which strictly prohibits racial profiling, empowers local police to enforce immigration laws.
To monitor the growing number of states considering similar legislation, ALIPAC utilizes a public forum in which members can update the organization with news articles and other information from states where the push for an Arizona-like law is making headway.
In Arizona’s neighboring state Utah, for example, Rep. Stephen Sandstrom, R-Orem, reportedly is drafting a bill that would similarly require immigrants to carry proof of status and require law enforcement officers to check for it.
“Utah is seen as state that welcomes illegal immigrants. We almost encourage it with driving privilege cards and in-state tuition for illegals,” Sandstrom told the Salt Lake Tribune. “With Arizona making the first step in this direction, Utah needs to pass a similar law or we will see a huge influx of illegals. The real issue is just establishing a rule of law in our state.”
Across the country in Maryland, Baltimore’s WBAL-TV reported earlier that State Delegate Patrick McDonough, R-Baltimore County, is drafting a bill identical to Arizona’s. He’s also planning to poll his fellow legislators before the bill is filed.
The cactus in the photo at right planted along the Arizona border with California gives a pretty good indication of the reaction of that state to the boycott directed at them by the Los Angeles city council over the new immigration law. Well, the results were overwhelming…97.6% of the respondents to this L.A. Timespoll were opposed to the boycott of Arizona. The poll question: “Was the L.A. A Reuters article reports “Two years after Vallejo, California, filed for bankruptcy protection, officials in nearby Antioch are also tossing around the ‘B’ word. Antioch’s leaders earlier this month said bankruptcy could be an option for the cash-strapped city of roughly 100,000 on the eastern fringe of the San Francisco Bay area. Antioch’s fiscal woes are standard issue for local governments in California: weak revenue from retail sales and property taxes is forcing spending cuts, layoffs and furloughs. But cost-cutting measures may not be enough to keep Antioch’s books balanced, so its city council is openly discussing bankruptcy. ‘We just want to alert people to the possibility,’ Antioch Mayor Pro Tem Mary Helen Rocha said.”
Arrogant liberals all over America continue to try to condemn and demonize Arizona for their attempts to keep illegal aliens from flooding in and bankrupting their state. Well, Arizona has responded by passing a law to ban ethnic studies courses.
An article on Fox News reports: “After making national headlines for a new law on illegal immigrants, the Arizona Legislature sent Gov. Jan Brewer a bill Thursday that would ban ethnic studies programs in the state that critics say currently advocate separatism and racial preferences. The bill, which passed 32-26 in the state House, had been approved by the Senate a day earlier. It now goes to Gov. Jan Brewer for her signature. The new bill would make it illegal for a school district to teach any courses that promote the overthrow of the U.S. government, promote resentment of a particular race or class of people, are designed primarily for students of a particular ethnic group or ‘advocate ethnic solidarity instead of the treatment of pupils as individuals.’ …Schools that fail to abide by the law would have state funds withheld.”
They must be serious. They actually put some teeth into it!
Why is Arizona of all places suddenly showing some backbone in racial matters? My guess is that it’s all those White people who fled from southern California over the years and who don’t feel like packing up and moving again. That’s the problem with “White flight.” Whenever White people flee, the Third Worlders always follow. Unfortunately, the good public schools in Arizona start filling up with Latinos. Gang bangers start committing crimes and Latinos start turning Arizona into a copy of a bad L.A. neighborhood.
The next interesting step will be to see what the Obama regime does about all these pro-White laws in Arizona. My guess is that the Attorney General is going to go running to federal judges to get injunctions against the laws. White people however are getting pretty sick of arrogant liberal judges inventing so-called Constitutional reasons to void any law that protects White people or that cuts hand outs to non-Whites.
If White people “working within the system” are not allowed to protect their interests, and the Feds step in to veto a perfectly legitimate state law, what will happen next? Will White people finally decide that they need a radical pro-White party that will support their interests instead of the tepid, timid Republican Party, which has been lacking a spine for decades?

The health care bill that Congress passed recently is now being challenged by 18 states to date. The constitutionality of the bill will be a close call, with strong arguments on both sides. As former staff director of the bipartisan Commission on the Bicentennial of the U. S. Constitution, I wish here to present – as impartially as possible – both sides of the case, believing along with John Stuart Mill that “he who knows only his own side of the case knows little of that.”

White House Press Secretary Robert Gibbs reported that its counsel opined that the individual mandate requiring all to purchase health insurance is constitutional under the commerce clause. True or wishful thinking? The nub of the controversy seems this: Will the Supreme Court, citing the commerce clause, permit Congress to regulate inactivity – that is, the absence of commerce – by forcing citizens to buy a certain private-sector service or product?
But to this argument, defenders of the bill will counter that the aim of the commerce clause is not to regulate economic inactivity but to regulate health insurance and health care – an altogether different focus.
In response, opponents of the bill will argue that health insurance is a 10th Amendment states’ right, not a federal government right. States currently regulate health insurance.
As if matters aren’t confused enough, the Supreme Court has taken polar positions on the commerce clause. In Gonzalez v. Raich (2005), it ruled that the commerce clause can be used to regulate home-grown marijuana even if only for personal use. But in U. S. v. Lopez (1995), it ruled that the commerce clause does not authorize federal law banning guns in local school districts.
The constitutionality of the individual mandate will also be tested under the 16th Amendment, which grants Congress the broad “power to lay and collect taxes on incomes.” Opponents of the individual mandate will argue that the mandate is not a tax, but a premium to insurance companies or a fine. Defenders of the mandate will counter that this premium or fine amounts to a tax, falling under the jurisdiction of the 16thAmendment. Also cited will be the enumerated power of the “general welfare” clause.
Opponents of the individual mandate will argue that the 16th Amendment, if used to permit the mandate, discriminates against freely choosing citizens who don’t want health insurance. But defenders will counter that the 16th Amendment already discriminates broadly: a graduated income tax is discriminatory. Mortgage deductions or deductions for children are discriminatory. We see a host of other discriminatory taxes whenever we file our yearly taxes.
Defenders of the individual mandate will argue that there are well established precedents for government coercion. Few people these days think that coerced social security payments or withheld Medicare premiums are unconstitutional. Car insurance is often cited, though that analogy fails: such is a mandated liability insurance for driving on roads and possibly getting into an accident – quite different from a mandated health insurance for simply living and breathing on American soil. And car insurance is a 10thAmendment states’ right, not a federal government right.
There is another unknown that could well enter into the matter of the constitutionality of the health care bill. The Supreme Court may elect not to meddle – on such an enormous, radical scale – into the domains of two constitutional branches of government: the presidency and Congress. Marbury v. Madison established the court’s power to rule an act of Congress unconstitutional, but the court in the health care matter might opt for recommending legislative relief.
Defenders of the bill will argue that the Constitution’s supremacy clause states explicitly that federal law shall be the “supreme law of the land.” Opponents will counter that federal law cannot be the supreme law of the land if that law is found unconstitutional, as in Marbury.
If any part of the health care bill is found unconstitutional, the whole bill fails because it contains no severability clause. Consensus holds that it will take two years for the constitutional challenge to progress through the federal district court, then the appellate court, and finally the Supreme Court. In the meantime, it is possible that an injunction from the district or appellate courts could put the entire bill on hold until the injunction is lifted or the case finally resolved.
My own view is that the Supreme Court will rule the health care bill unconstitutional because never in the history of jurisprudence has the court required a citizen to buy a certain private-sector product or service and never has it defined an insurance premium or resulting fine as a tax.
