SAN FRANCISCO (AP) — The sponsors of California’s same-sex marriage ban said Monday that the recent disclosure by the federal judge who struck down Proposition 8 that he is in a long-term relationship with another man has given them new grounds to have his historic ruling overturned.
Lawyers for the ban’s backers filed a motion in San Francisco’s U.S. District Court, arguing that Chief U.S. District Judge Vaughn Walker should have removed himself from the case or at least disclosed his relationship status because his “impartiality might reasonably be questioned.”
“Only if Chief Judge Walker had unequivocally disavowed any interest in marrying his partner could the parties and the public be confident that he did not have a direct personal interest in the outcome of the case,” attorneys for the coalition of religious and conservative groups that put Proposition 8 on the November 2008 ballot wrote.
They are now asking the judge who inherited the case when Walker retired at the end of February to vacate Walker’s August 2010 decision. The 9th U.S. Circuit Court of Appeals already is reviewing the legal merits of Walker’s ruling at the request of Proposition 8′s proponents.
Lawyers for the two same-sex couples who successfully sued for the right to marry in Walker’s court were reviewing the motion and did not have immediate comment.
Walker, a 67-year-old Republican appointee, declared Proposition 8 to be an unconstitutional violation of gay Californian’s civil rights last summer. He retired from the bench at the end of February.
Rumors that the judge was gay circulated during the 13-day trial that preceded his decision and after he handed down his ruling.
Lawyers for Protect Marriage, the coalition of religious and conservative groups that sponsored Proposition 8, however, have not previously raised his sexual orientation as a legal issue.
Protect Marriage general counsel Andy Pugno said that changed when the judge this month told a group of courthouse reporters about his 10-year relationship. The issue is not that Walker is gay, but that his relationship status made him too similar to the same-sex couples who sued for the right to marry, Pugno said.
“We deeply regret the necessity of this motion. But if the courts are to require others to follow the law, the courts themselves must do so as well,” Pugno added.
Walker said at the time that he did not consider his sexual orientation to be any more a reason for recusal than another judge’s race or gender normally would be.

“It is the obligation of every citizen of the United States, and every other person residing in the United States, who is between the ages 18 and 42 to perform a period of national service as prescribed in this title,” it specifies.
It would require that the president provide “for the induction” of people to the service corps.
“Except as otherwise provided in this section, the period of national service performed by a person under this title shall be two years,” Rangel wrote.
The exceptions provide that the term of service may be extended if the “member” needs to “compensate for any time lost to training for any cause” or “for the purpose of furnishing hospitalization, medical, or surgical care for injury or illness incurred in the line of duty.”
It gives the president the far-reaching authority to “prescribe such regulations as are necessary to carry out this title,” including what types of “civilian service” are required, “standards of satisfactory performance,” “penalties for failure” and “such other matters as the president determines necessary to carry out this title.”
Conscientious objectors would be ordered “to perform national civiliain service … as the president may prescribe.”
The group Operation Sit In said it is coordinating information to link up those who “have the time to go to D.C. at the drop of a hat to keep the Senate from passing the Universal National Service Act … with those who would like to go to stop it, but cannot afford to lose their jobs by taking off with no notice.”
National Director Larry Richardson said, “Most of those who have the time and freedom of time to go are out of work because of the current economy, and therefore are short on funds to go. So we match those who still have jobs with those who do not, and with everyone doing a little, no one has to do it all.
“We also are arranging for people who live fairly close to D.C., (within 50 or so miles), to let us park our cars on their property, at home or business, so we do not have to worry about them being towed while we are in D.C.,” he said.
“We need every PATRIOT to step up and help in this,” he said.
A spokesman for Rangel’s office, Emile Milne, told WND that nobody knows what such a plan would cost, but presumably those in full-time service to their country as civilians would have to be paid, how many people would be conscripted or other details.
“It would have to move through committee,” he said. “These questions … certainly would be addressed by the relevant committee.”
He said the discussion in Rangel’s office is that those in the civilian corps would work in “education, health care, they could work in our ports, various aspects of security.”
He also said the idea has been a long-term goal for Rangel.

Officials said at that time the law would allow for the “managing” of up to 8 or 9 million people.
That bill includes a “National Service Reserve Corps” whose members have completed a “term of national service,” “training” and “not less than 10 hours of volunteering each year.”

On September 17, 1787 George Washington was the first to sign and accept the Constitution even though it had no Bill of Rights. It was Patrick Henry with his great speeches and lectures who in 1788 forced an agreement which promised that continued ratifica- tions of the document depended upon a Bill of Rights to be forthcoming. In 1789 Washing- ton took office and was faced with the arduous task of pioneering the first presidency including the structuring of the militia system. By January 1790 the influence Patrick Henry had over him became quite apparent. When Washington chaired the 1787 Constitutional Convention, provi- sions had been made for the defense of the country against invasion and for stifling rebel- lions, but there was an insuf- ficiency of safeguards to be applied against tyranny brought on by public officials.
By 1790 Washington began work on his “Plan No. 2 for the Organization of the Militia.” By now he was more able to see the weaknesses in the Constitution. He openly discussed the threat of tyranny emanating from within the government. By then, Patrick Henry’s wisdom was spread throughout the 13 original states, and it was inculcated as the basis for the policies and functions of the militia. Henry perpetuated the people’s liberty. He sustained the ultimate authority of the people. Washington well under- stood the need to safeguard the nation from its foreign enemies. In his “Plan No. 2 for the Organization of the Militia” he

Washington himself took the farmers out for practice, and he utilized the knowledge and experiences of his generals and other valuable officers in the War for Independence by having them instruct and train the citizens (the whole people) in the techniques of soldiering, and the maintenance of an ‘energetic national militia’.
His “Plan No. 2 for the Organization of the Militia” was communicated to the Senate, on the 21st of January 1790. This lengthy Plan was permeated with the proposition that it is the direct duty and responsibility of the people themselves to guard against tyranny from within government.
Washington declared that the purpose of the militia was “to oppose the introduction of tyranny.” He had come a long way from the days when he accepted the Constitution without a Bill of Rights.

This excerpt is a part of Wash- ington’s lengthy Plan No. 2 of 1790. While he also made re- ference to the prevention of invasion and rebellion, Washing- ton said that “the well informed members of the community (the people) were meant to be the real defence of the country”; and “the virtues and knowledge of the people would effectually oppose the introduction of tyranny.”
He warned that “the government would be invaded or overturned, and trampled upon by the bold and ambitious” — meaning people in our own country who operated without adherence to vital principles. The absoluteness of the right of the people to keep and bear arms is a basic principle. Unless the right to arms is absolute, the people cannot remain the ultimate power. The Bill of Rights confirmed that we possess many other rights beside the absolute right to arms. All of the other rights for the preservation of their own existence, depend entirely upon the absoluteness, the force, and the reasoning that have shaped the Second Amend- ment. Washington agreed with Patrick Henry on the purpose of the militia: It was to “oppose the introduction of tyranny.” Make no mistake about it: The prime reason for the Second Amend- ment is prevention of tyranny in government.

Officers confirmed they were investigating but would not release any further details about how the alleged offences came to light. A Council on American-Islamic Relations adviser and regular speaker at its events has suggested Islamic law permits Muslims to attack C-130 military transport planes carrying the 82nd Airborne out of Fort Bragg, N.C., according to a stunning new book exposing Washington-based CAIR’s inner workings.
Radical Islamic cleric Zaid Shakir, a frequent guest speaker at CAIR events, tells his Muslim audiences: “Jihad is physically fighting the enemies of Islam to protect and advance the religion of Islam. This is jihad.”
Acceptable targets of jihad, he says, include U.S. military aircraft.
“Islam doesn’t permit us to hijack airplanes filled with civilian people,” Shakir once told a Muslim audience. However, “If you hijack an airplane filled with the 82nd Airborne, that’s something else.”
The 82nd Airborne Division’s elite paratroopers fly out of Fort Bragg, N.C., which is part of North Carolina state Sen. Larry Shaw’s district. Shaw is CAIR’s new chairman.
The bombshell revelation comes in the wake of the worst military massacre at a domestic U.S. military base in American history, and the worst Islamic terrorist attack on U.S. soil since 9/11.
Last week, Army Maj. Nidal Malik Hasan allegedly gunned down in cold blood more than 50 of his fellow soldiers preparing to deploy to Iraq and Afghanistan from Fort Hood, Texas. Eyewitnesses say before opening fire, Hasan jumped up on a desk and screamed, “Allahu akbar!” like the 9/11 hijackers. The suspect fatally shot 13, including a security guard. The death toll is actually 14 when a slain unborn child is counted.
Imam Shakir also gives his blessing to the use of bombs as a weapon of jihad, as long as the explosives hit “select” targets and are not indiscriminate in their destruction. Civilians can be a legitimate target, he says, if “there’s a benefit in that,” according to “Muslim Mafia,” co-authored by former federal agent P. David Gaubatz and investigative journalist Paul Sperry, author of “Infiltration.”
Even “old elderly men” and “women who are conscripted” – including Israeli and American women in uniform – are eligible enemy combatants in jihad. “This isShariah,” Shakir asserts in a CD recording of one of his lectures in 2001, which the authors obtained from a radical mosque bookstore in Brooklyn, N.Y.
Shakir, a black convert, has been portrayed as a moderate in the mainstream media, including the New York Times, which recently ran a positive profile of him. His pro-jihad statements revealed in “Muslim Mafia” have not been previously reported. CAIR has sued and obtained a temporary restraining order to censor the book’s documentary evidence detailing CAIR’s support of terrorism and obstruction of FBI investigations.
Longtime CAIR advisory board member and chief fundraiser Siraj Wahhaj echoes his friend Shakir’s interpretation of jihad.
“If we go to war, brothers and sisters – and one day we will, believe me – that’s why you’re commanded [to fight in] jihad,” the imam has told his flock in Brooklyn. “When Allah demands us to fight, we’re not stopping and nobody’s stopping us.”

CAIR has invited Shakir back to speak at its events even after the FBI questioned him about a copy of one of his incendiary pamphlets found in the apartment of a suspect in the first World Trade Center bombing. The pro-jihad pamphlet lauded the “armed struggle” that brought about the rule of the Taliban in Afghanistan, where U.S. troops are dying in record numbers from Taliban and al-Qaida ambushes.
Shakir, who recently confided to the New York Times that he’d like to see the U.S. “become a Muslim country” ruled by Islamic law, is a regular speaker at CAIR as well as Islamic Society of North America events. (Federal prosecutors say CAIR and ISNA are fronts for the terrorist group Hamas and its parent the radical Muslim Brotherhood, and the sister organizations were recently listed as unindicted terrorist co-conspirators in the largest terror finance case in U.S. history.) Recently, Shakir helped host workshops and delivered keynote speeches at banquets held at CAIR chapters in Chicago, Orlando and San Diego, among others.
“Imam Zaid’s speeches are very practical and bring the best out of his listeners,” said former CAIR official Ibrahim Moiz, a close personal friend who invited Shakir to speak to Muslims in Maryland, according to “Muslim Mafia.”
The cleric has not tempered his jihadist views.
“I don’t regret anything I’ve done or said,” Shakir has insisted.
Shakir holds little, if any, respect for law enforcement, particularly the FBI, according to “Muslim Mafia.” He constantly belittles the bureau in speeches to Muslims, even warning them that the FBI frames Muslims for terrorism – terrorist acts that he contends the FBI secretly commits.

SARGODHA, Pakistan, April 28 (CDN) — A Christian barber in this Punjab Province city is still recovering from broken bones and other injuries sustained earlier this month after eight Muslims allegedly beat and sodomized him for cutting the beard of a Muslim.
Marwat Masih, 29, initially refused the request of 19-year-old Qandeel Cheema to cut his beard in Sargodha’s Gulshan-e-Bashir town on April 13, knowing that area Sunni Muslims believe the Quran prohibits it. But Cheema, a high school student, told Masih that he had lived and studied in Lahore and therefore wanted a more modern look, the bed-ridden and feeble Masih told Compass.
“I refused to shave his beard, but he showed me his packed bags and said that he would leave the town straight after the shave, and so no one would ever know that I had shaved his beard,” Masih said.
Eyewitnesses told Compass that as Masih was cutting Cheema’s beard, the client’s older brother – local radical Muslim land owner Shakeel Cheema – was returning by tractor from his fields and, noting the family Jeep in front of the Marwat Hair Stylist shop, stopped in.
“When Shakeel Cheema saw me shaving his younger brother’s beard, he became angry and started vandalizing mirrors, the sound system and chairs, and he desecrated a wooden cross perched on the top of the front mirrors,” Masih said. “He also started beating my head with his shoes.”
Eyewitnesses told Compass that Shakeel Cheema shouted orders to his companions to tie Masih up and throw him into the wagon attached to his tractor, and that he ordered his younger brother to leave for Lahore at once.
Masih said that he was blindfolded with a black cloth and taken to an unknown place where he was locked in a room. An hour later, Shakeel Cheema and seven others arrived and began striking him with clubs, breaking his ribs, a wrist and leg bones.
“Shakeel Cheema said, ‘Now we are going to teach you a real lesson for shaving the beard of a Muslim man,” Masih said, and after a long, pained pause he related how Cheema and the seven others sodomized him. “I started bleeding and fell unconscious.”
His father, Laal Masih, older brother Hassrat Masih and other relatives had begun searching for him, and after midnight that night they found him lying half-naked and unconscious off the main street of Gulshan-e-Bashir town, his father told Compass. They immediately took him to Rural Health Centre, where doctors kept him under observation for two days and treated him for internal bleeding and the broken ribs, leg bones and wrist.

Homosexuals have historically accounted for the bulk of gonorrhea, Hepatitis B, TB, etc.(15).
Homosexuals are 100 times more likely to be murdered (usually by another homosexual) than the average person, 25 times more likely to commit suicide (3).

Consider the fact that the average homosexual has 50 to 70 different “partners” every year, you can see if they start this lifestyle when they were 20-years-old , most of them will come down with AIDS or be dead by the time he is 30.
The average American now lives to be about 70, but do you know that less than 2% of homosexuals survive to that age? According to Dr. E. Fields in “Is Homosexual Activity Normal?” for male gays who die of AIDS, the median age is 39. For male gays who die of something else, the median age at death is 42. The median age at death of lesbians is 44.
CATHOLIC FOSTER CARE IN D.C. FORCED OUT
As reported in today’s Washington Post, Catholic Charities in the Archdiocese of Washington has ended its foster-care program. At issue was the right of the archdiocese to reject gay marriage and remain a city contractor; a bill legalizing same-sex marriage recently passed in the District.
Catholic League president Bill Donohue supports the archdiocese:
Archbishop Donald Wuerl is a man of principle and prudence: he did not want to end the foster-care program, but he was left with no realistic option. District lawmakers could have granted the kind of religious exemptions that would have ensured a continuation of services, but instead they sought to create a Catch-22 situation for the archdiocese. Surely they knew that Archbishop Wuerl was not going to negotiate Catholic Church teachings on marriage, yet that hardly mattered to them. The real losers are the children who were served by the Catholic Church.
Those who say that Wuerl is throwing the kids overboard are phonies. If Planned Parenthood were told that as a condition of public funding it had to refer Catholic women having second thoughts about abortion to a crisis pregnancy center, it would scream violation of church and state, refuse the money and end this program. Well, Archbishop Wuerl isn’t about to allow the state to run roughshod over Catholic doctrine, and that is why he is being forced to drop the foster-care program.
Prudent lawmakers interested in balancing church and state interests and servicing children would not seek to impose secular views on sectarian institutions. But that’s not what D.C. legislators opted to do, leaving Archbishop Wuerl with no realistic alternative.

Words mean something. Noah Webster knew that well. Just hearing the word sodomy sounds harsh. This is evidence of how far we have slid.

In 1988, 74.9% of the American Public thought that sex between two people of the same gender was always wrong. By 1998, the percentage had fallen to 54.6% (National Opinion research Center, The University of Chicago.)
Perhaps no other movement in the history of America has had so much success in such a short time. We must examine the homosexual agenda’s success in changing American Culture and attempting to redefine the family, not only to understand how to combat it, but to provide a glimpse of the potential of the American Church if only we were so vocal and dedicated.
The Homosexual Agenda
The strategy was revealed 20 years ago in a 1987 article titled, “The Overhauling of Straight America,” and a 1989 book titled “After the Ball.” In which two radicalized homosexual activists Marshall Kirk and Hunter Madsen published their plan. Both Kirk and Madsen were highly educated men. Kirk was a Harvard educated researcher in neuropsychiatry, and Madsen had a doctorate in politics from Harvard, and was an expert on public persuasion tactics and social marketing. (The Marketing of Evil, David Kupelian, p.23)
Their strategy was six fold:
1. Talk about gays and gayness as loudly and often as possible. 2. Portray gays as victims, not aggressive challengers. 3. Give homosexual protectors a “just” cause. 4. Make gays look good. 5. Make the victimizers look bad. 6. Solicit Funds(Get corporate America and major foundations to financially support the homosexual cause. (The Homosexual Agenda: (Exposing the Principal Threat to Religious Freedom Today. Alan Sears & Craig Osten, p. 18)
Let’s briefly examine these strategies.
Firstly, Kirk and Madsen in The Overhauling of Straight America, write in regards to talking about gays and gayness, “The principal behind this advice is simple: almost all behavior begins to look normal if you are exposed to enough of it at close quarters and among your acquaintances.” (Sears and Osten p. 18)
“The main thing is talk about gayness until the issue becomes thoroughly tiresome.” According to Sears and Osten this will have one of two effects. “1. It convinces people that homosexual behavior is just another lifestyle, or 2. causes them to get so sick of the issue that they throw their hands up in disgust or become exhausted and then withdraw. Either way the homosexual activists win.” (Sears and Osten 17-18)
Portraying homosexuals as an oppressed victim is the second part of Madsen and Kirk’s strategy because it plays into all Americans sense of fairness. This can be seen in the framing of the AIDS debate (primarily spread by homosexual behavior) as a civil rights issue (AIDS was formally called GRIDS, G stands for ‘Gay”) He who frames the argument wins.
This was also seen through the Matthew Shepherd murder case when two non-religious men killed another man for drugs. The case was blown up by the national media to be a homophobic hate crime spurred on by “hateful” evangelicals preaching against sin. In the media Christians are then compared to Hitler and the KKK, instead of Mother Theresa, William Wilberforce (the Christian who abolished the British slave-trade), and Dr. Martin Luther King Jr.
By piggybacking on the civil rights issue and slandering blacks, homosexuality has become the cause de jour to appeal to liberal sensitivities of fairness and justice. The “Gay Rights” issue is now seen as a “just cause.” Examples of this in Hollywood are the film Philadelphia, where Tom Hanks is fired from his job by discriminating hate-mongers, and Broke Back Mountain where Heath Ledger can’t really live out the true love and life he wants because of an oppressive society. Rather than showing two men living in San Francisco with high discretionary income and a lavish lifestyle they are shown as oppressed and victimized. This idea of making the homosexual appear oppressed and the victimizer bad can adroitly be perpetuated showing scenes of Fred Phelps, (of God Hates Fags lore) protesting funerals which furthers the myth that Christians are mean and bigoted people.
Lastly, soliciting funds for radicalized homosexual groups has been widely successful. Ford Motors, Kraft, Home Depot, Proctor & Gamble and many more corporations indirectly or directly contribute to the advancement of the homosexual agenda. They do this through sponsorship, advertising, donations, and legislative endorsement. Careful coordination with corporations and the media have been tools in the propaganda campaign to mainstream homosexual sodomy. These are the engines that drive the homosexual activist groups such as GLSEN (which are proliferating our schools), and Equality Forum (A lobbying and legislative homosexual group.)
Eric Pollard, the founder of ACT-UP (a militant homosexual group) claimed Hitler’s Mein Kampf as a model for the “gay” agenda. (Sears and Osten, p. 26)

Kirk and Madsen reiterate Pollards ideas, “We have in mind a strategy as calculated and powerful as that which gays are accused of employing by their enemies. It’s time to learn from Madison Avenue, to roll out the big guns. Gays must launch a large scale campaign to reach straights through the mainstream media. We’re talking about propaganda.” (Sears and Osten p. 27) So far they are achieving their carefully laid out goals.
The Human Face of Homosexuality
We all know friends who are “gay,” and many are genuinely nice people.
What is the real face of homosexuality? Is it the radicalized homosexual trying to legalize sex between men and boys (NAMBLA)? Is it someone like Rosie O’ Donnell or Ellen? Or is it our coworker or family member, our son or our daughter? Is it the people who shut down the local parks for public sex within eyesight of children, leaving condoms strewn around the park? Perhaps it is all of these for sin has degrees of evil.
In my own life I see various shades of this sin that traps so many. A friend of mine once shared with me that he watched his father commit suicide when he was 15. Since then he has engaged in hundreds of acts with other men and is currently in a “monogamous relationship.” Perhaps he is seeking the love of the father he never got. Another young man I know suffered seizures, and increasing paralysis, and died earlier this year from AIDS which he contracted from earlier involvement in homosexual sin. Two friends I know have parents that left their families for another “same sex” partner. Their families have been torn asunder. Behind the glitzy glamour of Hollywood are real people with real sin which has real consequences. Who will speak the truth to these people, to these families?
Counting the Cost
Last year I submitted a resolution to the State Convention of Ohio Baptists urging Christian parents to pull their children out of public school and either home school or provide Christian private education. It was a wakeup call to pastors and parents in our state newspaper due to the advancing homosexual agenda and Darwinian dogma in public schools. Within the next few weeks homosexual activists wrote in and repeated the tired old saw calling me a bigot, or exclaiming that I was spreading hate. One person said there was no gay agenda in schools that the only agenda was for her to get up go to work and pay taxes like every “normal” American. Being called names in a newspaper or blog is a small price to pay. In the future it may not be so easy.
We have already seen in Canada where a free speech chill has come after the passing of hate crimes legislation. The same legislation is being advanced in America (SB 777 in California, and through hate crimes bills.) Canadian Pastors have been fined for speaking out against homosexuality. Programs like Focus on the Family are not able to be aired in Canada.
It is time to count the cost. We have all the freedoms and opportunity now to confront this sin. But time is running out. Will we sit cowardly in our stained glass fortresses while Sir John David Michaelis’ words ring prophetic towards America, “that the foundation of its future decline is laid?”
If a 1-2 percent minority can change the face of American Culture and public policy, then anything can be achieved.
We have both the numbers, and the truth. If speaking the truth is a hate crime. Let us be found guilty.
