Articles of impeachment against Justice Roberts for perjuring during his Senate hearings, where he said he wouldn’t be a judicial activist, and he wouldn’t overturn precedents.”
According to DeFazio, Roberts hasn’t stood by his own doctrine. He pointed to former Justice John Paul Stevens‘s dissent in the case, in which he said the Citizens United case was not properly brought before the Supreme Court. “This procedure is unusual and inadvisable for a court,” Stevens said of the process. “Our colleagues’ suggestion that ‘we are asked to reconsider Austin and, in effect, McConnell,” ante, at 1, would be more accurate if rephrased to state that ‘we have asked ourselves’ to reconsider those cases.”
“Justice Stevens makes the point that Roberts decided a case that wasn’t even before the Court, and invited the issue before the Court,” said DeFazio. “It was the most extraordinary condemnation I’ve ever read of a perverted majority on the Supreme Court, at least in recent years.”

WASHINGTON — Overruling two important precedents about the First Amendment rights of corporations, a bitterly divided Supreme Court on Thursday ruled that the government may not ban political spending by corporations in candidate elections.

I just returned from the Capitol in Helena, and it’s not looking pretty. I want to alert you about two very bad bills (and one good one) coming on Tuesday January 29, 2013.
In spite of 75% of Montana voters supporting I-166, some of these legislators are ushering in a new era of corruption. They think we need more big money in our elections. They must not have been paying attention on Election Day.
Two bills that would gut our campaign finance laws have hearings on Tuesday, Jan. 29. On that same day, there is another hearing on a resolution that echoes the will of Montana voters expressed through I-166.
The Good
HJ 6, sponsored by Rep. Ellie Hill (D-Missoula), is a resolution that mirrors I-166 and calls for an amendment to the U.S. Constitution to overturn the Citizens United decision.
The Bad
HB 265, sponsored by Rep. Steve Fitzpatrick (R-Great Falls), would increase contribution limits by as much as 484%, including the limits on contributions from PACs and political parties.
And the Ugly
HB 229, sponsored by Rep. Scott Reichner (R-Bigfork), would increase contribution limits by as much as 397%, wipe out any limits on contributions from PACs and political parties, and repeal our ban on corporate contributions.
All of the hearings are scheduled for Jan. 29 at 8:00 am
